We're cutting all cc up tonight as sent dmp agreement and statements up today! :j CCCS say it's not going to be until nov till we start so gives us two months with no spends on them - we're just about able to manage by sending minimum payments they ask for until then so hopefully they'll have no complaints (husband getting some commision).
Well it's all starting for real today - looking forward to it strangely - justhope our creditors are nice with us! :eek:
I think the advice is to pay less than minimum payments (ie token payments of £5 or £1) until the DMP starts rather than making the minimum and trying to cope. hi all
am feeling v v fed up today. had 3 missed calls from an '08455' number last night - tried the ''whocallsme'' site but not listed. i think its lloyds solicitors -SCM who have recently sent me a harrasing '' pay up or else'' letter.
why do some creditors accept dmp payments -no hassle / stop interest etc - & then some i.e. lloyds are awful?
i honestly thought Northern Rock would be bad - they are our largest creditor and accepted a much lower payment straight away.
somedays i think bring on the defaults / ccjs and then days like today ,the thought of a ccj is scaring the bejesus out of me!!! :eek:

HI Just thought i should let you all know have posted a couple of times on here and now have written to all creditors asking if they would be happy to deal with me instead of Payplan. I am amazed at what i have discovered and feel very stupid.
1. Payplan do not keep upto date with any company, I have discovered that they make payments until they think you are debt clear then write to everyone again for balances.
2. If I let payplan carry on with all of this they would be getting us into a lot more debt as I have discovered that HSBC (old bank account overdraft) is charging more interest than payplan is allowing them in payments, HFC Bank appear to be doing the same, it took me weeks to come to an arrangement with GE money as they said they had not heard from payplan in the nearly 2 years we have been with them, so with GE money not only did i get the interest frozen myself but I also got a lot of it back.
3. I am tired of payplan lying to me. They never ever ring back, and it seems now the only time they contact me is when they want to be a broker for me on car or house or pet insurance.
4. BAck to GE money payplan sent GE money an email apology saying that they had been at fault and had not sent the documents they say they had sent. When I confronted Payplan with this they told me GE money were lying and that they would look into it - again never rang me back.
There are many other things I am unhappy with but I have now in a few short weeks
Got the obudsman involved with hsbc as they agree hsbc caused the overdraft in the first place and have upheld my complaint.
Got PPI Back from egg (who I have to say acted brilliantly)
Got interest stopped with GE money and got money back
Got further interest and charge freezes with just about all creditors now
Had replies from all but two creditors who are happy for us to pay them direct and keep the arrangment going.
If I had not found the strength to do this our debt which we hoped to be paid in full in 5 years would have gone on for approximately double that because payplan do not keep a regular check on balance interest freezes etc.
BEWARE.

I used to think Payplan were marvellous but I am constantly arguing with them now- I've never encountered such mass stupidity or incompetence sorry! I might well manage my own DMP at some point but to be honest and aside from payplan, I am just double checking what they are doing, and making my own arrangements because as you say- the only time they try and contact you is if they want to sell you something- like I cannot go online to price comparison sites!now debt free and determined to maintain good spending habits and build savings0 -
sas, We all must have those days, I think I had a whole week of feeling like that lasted week. But this week things seem a little birghter : ) I actually don't think about my debt as much now as I did before my DMP, as then I would be wondering which cc to use for the next lot of shopping or petrol! now I actually go days without any thoughts given to my debt, then I'll get a letter or something comes up I need to sort out, like last week when I was thretend by court action, BUT you have to remember no matter what they throw at you, say to you or write in their letters, you're in a better position then before and recall the reaosns you first did your DMP (its easy to forget!). I hope you start to feel a little better this afternoon and I'd advise to answer the calls, just be polite (they hate that more than anything!) and don't say anything just listen to them and um and ah, may help you to feel better knowing what they are calling you for ?

you are sooo right. was exactly the same re the cc - when i think how i even used to take cash out on them juist to 'live' - - shudder.

& yes - i will speak to them (if they call - just tried calling the number back now - it goes straight to a voicemail but still have no idea who it is!!)

You would need to carry on until they actually default on your CCA request. Assuming they didn't send it to you or it wasn't enforceable then you can stop paying them, if thats what you choose to do.
I have an unenforceable debt with HFC bank (GM Card), the balance is around 9k, I am continuing to pay it as I personally believe in repaying what I owe. Obviously each to their own and I suppose there are a lot of people who would just stop paying.
Please be aware though it's very unusual for a creditor just to disappear without a fight if you do decide to stop paying. When it comes to unenforceable agreements its all a bit of a lottery, some county court judges don't even know the law themselves & will listen to the creditors solicitor. I've been through it once, attending court 3 times alone was very scary especially knowing your up against a pro who knows how to confuse the law, I wouldn't be lying if I said I never want to go through it again. At the end of the day though you have to fight for your legal rights, no matter how hard it is.:j DMP mutual support thread member - 135:j0 -

Received my statement from Capital one today (less interest)
and a letter from Next yesterday accepting too
4 down - lets hope I heard from the other 8 soon!

Many Happy returns for 2moro Muddlemess - hope the budget runs to a cool glass of something nice!
We're in it too for the long haul but its a bit like climbing a hill, I wouldn't have believed how far we've progressed already and thats before the DMPs even started.
I nearly had a heart attack when I realised we had to change banks,etc, but, hey, it all happened and nobody died!
