    Ooooo that sounds interesting RayDay please tell more..... Lloyds are my biggest creditor and they are still adding charges and interest on my account. I'm just about to send them a letter from National Debtline asking them again to freeze my account. If that fails I am going to request a CCA which I don't think they will be able to provide.

    Is that the route that you took with them or did you try something else?

    I didn't request a CCA but using this http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf I spent time going through and listing there "crimes" if you like. At the top of the letter I put formal complaint and I clearly told them what I expected them to do to make me happy, ie, freeze interest and refund charges (which I had listed along with token payments I had sent) I also listed the amount of correspondance they had sent.

    It was a bit of an epic letter and a moan but it worked.

    I hope I don't offend anyone here but the only times I have requested CCA is when a company would not look for payments I had sent and it was cheaper to send a CCA than request copies of cheques I had sent. I want to pay all I owe because I did borrow it, however, I do expect them to be fair about how they conduct the accounts, what they charge and harrassements. As far as I am concerned if you have written to them and told them you are having trouble they should respect that and help.

    Oh also in the letter I pointed out that they sponsor the national debtline so why were they not cooperating with me when all I was doing was following the national debtlines advice.

    I do hope I haven't offended anyone with the CCA bit, this is just my opinion and I am not right or wrong in my thinking.

    Thanks for that RD... The only reason I would request a CCA is to let them know I am aware of my rights. I'm more than happy to pay them back what I've had - I just think they are making the situation worse by constantly adding late charges and interest when it's obvious after 5 months of CCCS payments and prior to that no missed minimum payments apart from two token payments.
    Hopefully the letter asking them again to freeze interest will be enough but you never know with these organisations...
    TBH I would like to use the CCA as a bargaining tool.. almost like 'I know I don't have to pay you this money but I'm more than happy to if you stop all the ridiculous extra charges etc.
    Hope this makes sense?

    I understand completely and I remember only too well the frustration of dealing with Lloyds. But if you lodge formal complaints you do at least get letters back that answer questions where previously all I got out of them was standard contact us etc etc

    I to be honest have not had much luck with CCA the time I did use it, I have since been passed onto another DCA and had to do it all again. Actually I tell a lie I have done it twice once for the charges and once because I had two DCA chasing the same debt and did not know who to send payment to. It definately shows them you know your rights.

    I know others do the CCA route its just me personally have had no peace from that and I wouldn't judge anyone who did that - but bloody good luck to them and if they can sort mine out for me they would get medals! lol

    Pants it works for me try "OFT Debt Collection Guidance" when you do find it try to quote it as much as possible where Lloyds have messed up, like you said previously show them you know what you are doing. You can guarantee they won't have a clue!

    Hi all,

    sorry not been here for a while, but have been reading with interest. Heart still going out to all the newbies just starting out.

    However, sad to say I am nearing the end of mine and I am finding this more stressful than when I started! I offered F&F to all of 40% (I am down to £700 owing to all creditors now), but they have all refused and got another months money this month and due to get some more of my hard earned lolly on 1st August. I have to say none of my 5 creditors froze interest and I am a believer now than I spent it, I owe it. My friend has kindly offered to clear all balances, but noone can tell me the best way to do it. Do I just have the money transferred to my account and ring them paying them off? Do I go through Payplan who i am concerned will not do this in a timely manner and I will end up paying the balances and another months money or incurring more interest while they do it so the balance is incorrect at the end and I still owe them money? Payplan say they want to "negotiate" my last payment, but I dont want that as it will just give me a partial settlement and I want full satisfied on my credit rating.

    Has anyone done this and how did you go about it? I am so lost. I get one shot at clearing this once and for all and I have to get it right. What should have been two years is now four and I want my life back.

    Hi Everyone,

    I've filled in the CCCS forms, cancelled the direct debits and sent the DMP notification forms to my creditors. I nearly had second thoughts before posting the envelopes, but as I can't see another solution, will grit my teeth and hope the ride doesn't get too rocky. I checked by Experion report at the weekend and it didn't look too bad, heavily committed (I knew that!) but lots of green dots and only a few amber ones. I'm a bit worried what will happen next, at least I'm not with Lloyds!!

    Now is the time that you could negotiate the interest they never froze. If you have got the time you could total the amounts you paid and the original debt and give them the offer (think national debtline have template letters) and point out that they should take this considering the interest they continued charging despite the fact that you informed them of your genuine problems, bargain a little with them see how it goes.

    I have never done it personally I fought to get interest refunded and am a long way off paid up! There was someone on here who had done it the way I mentioned above but I can't remember their name at all - sorry!

    If you do do the offers I would offer less than what you have just to get the dialogue going. Then you have a little in reserve if you go straight in with what you have you have no room to negotiate. Also remember that DCA buy debts for a fraction of what they were originally but will try it on to get more.

    Hope that made a little sense I am full of cold and a bit foggy tonight!

    Well done the first few months, the time deciding and the time setting up are usually the worst and your confidence is at its lowest. But you have done it now, initially companies will moan, try it on but then give in mostly. Lets face it there must be thousands if not millions of people struggling, its unique situation to you but ones banks are seeing more and more.
