She could easily take a screen cap the email ebay are meant to have sent her and send it to you, proving that she 'won', just ignore her send the shoes to the real winner and unless you get a letter from her solicitor, forget about it. surely her solicitor would realize that this is ebays fault and not the sellers anyway0

Theres a special way to deal with loons like this, it's called the delete button. Still I'd wind her up and threaten High court action for Harassment0 -
I would like to offer my legal services. Please forward me a cheque for £100 to cover it and I will deal with the customer and their solicitor.
All I can say is d'oh, d'oh and d'oh.
Ebay's main fault is generally down to its users if there was no one on it there'd be no problems.

For the record, they cost me about £45 six years ago. The only other person to contact me was to ask if they fitted small as her daughter had a prom coming up - I was a bit sorry to tell her that they did
I can see if I did send these shoes to her, she'd find some 'defect' on them and claim via Paypal. She's won another auction of mine and I can forsee her trying not to pay until she gets 'her' shoes!

Not sure if I'm missing the point here but was has the non-winning bidder lost exactly? She hasnt parted with any money or received any goods from the OP so no contract has been entered into - where is her "case" exactly?? My OH has told me I should refund the legitimate buyer, explaining the situation. I have done this, but I'm really not happy doing it, as she won the auction and it's not her fault someone's trying it on.
I also refunded the shoes the dodgy buyer paid for as I have no desire to deal with her if she kicks off like this.why ever would you do that?

Let me clarify.
I was happy to send the shoes to the winning buyer. However, this is my boyfriend's account and he wanted to cancel the auction entirely and relist the shoes at a later date. As it's his account, it's his decision to make. I refunded the legitimate buyer, who understood.
Secondly, he suggested that we refund the dodgy bidder for the shoes she actually won, as all the signs pointed to her being a pain in the !!!!. We got several e-mails from her yesterday:
"Dear XXXXX,
hi there, i was a little perturbed to return home tonight and find an
unpaid item dispute open for the pair of shoes i bought and paid ypou for
today. somehow they had been mistakenly refunded but i have reversed this
and the money is with you ready for my shoes to be sent to me, i go on
holiday next week so hopefully you would be able to send them by then?
thanks again.
-[ODD BOD]"
"You also have a duty to provide me with a reason as to why you have now
taken my money and started an unpaid item dispute, but are refusing to keep
your side of the contract. I suggest you send the shoes which have been
paid for, and leave the courts to decide the outcome of the other case, be
it your fault for cancelling the bid, or ebay's for not providing you with
the correct information, that is now for the law to decide as I 'm sure you
will appreciate. "
She then requested my boyfriend's details so he called her to ask what was going on. He tells me she was still threatening legal action. His words to me were 'I don't want to deal with legal threats.'
"Dear [Mr Mippy],
Hi there, this is not acceptable. Your legal contractual duty is to post to
me the shoes which I have bought, and as you seem to be unwilling to do so
I will be contacting ebay and as I have said before, you will be hearing
from my solicitor on these now TWO counts of breach of contract. I would
also appreciate no more harrassing and distressing phone calls."
I'm really really upset now, because this has become a big mess and now my boyfriend has to deal with someone sending legal papers for one pair of shoes that she didn't win and another that we have REFUNDED on the grounds that the item is now unavailable (to loons like her).0 -
Sounds like a lot of hot air to me, wasting money on a lawyer for a £50 pair of shoes.
They really do sound like they are really full of themselves, I really doubt they will go ahead with their empty threats.0 -
Well your boyfriend shouldn't have given you such stupid advice in the first place ! But no-one is going to send legal papers -she's talking utter bull.
