It's much in keeping with their greedy attitude to selling fees, where, even in instances like the ones we are discussing where sellers are forced to refund despite having no legal obligation to do so, ebay still do not refund the selling fees for the transaction.

Amazon have a similar policy on refunds, but the main difference is they don't allow auctions on their site so all sales on there are subject to distance selling regs, pretty much, but they do refund selling fees if you refund a buyer. Why don't ebay?
Isn't this going to change soon http://pages.ebay.co.uk/sell/april2009/returns.html or is that not the case?

It's a shame when buyers simply change their mind or an item doesn't fit, that they can raise a "not as described" case even after they've had the item a month.

I have been trying to keep out of these quite heated arguments but I do agree with Cyril that it has become a bit one sided in favour of buyers.

If the item is as described (this in itself is a minefield) and the item is sold by a private seller (another minefield many private sellers could quite easily be viewed as traders) then refunds should not be the order of the day.

If it is a business selling then the DSR should kick in ie returns must be notified within 8 days of recept etc.

The fees issue could be argued both ways but I like the Amazon system.

Asking for a refund 28 days later is jist taking the mick and in my view PayPal are in the wrong.

I think a lot of people are missing the blatantly obvious. What sort of situation would mean that every buyer could return any item for any reason?

An entire site of business sellers maybe....?

A no-quibbles return policy is also a very good way to rasie the bar for the quality of service provided by third party sellers on their site.

As I see it, this is just another nail in the private sellers' coffin. The free listing for 99p start auctions is now well on the decline - too many people have either seen expensive items sell for the opening bid, or are bored relisting the same unsellable item for the last few months.

Ebay are simply social engineering the site to meet their own long term strategy. It's either fall in line, or sell elsewhere - this hypothesis is only reinforced by the recnet emails that come out in reference to policy changes; the last line is always along the lines of "If you do not agree with this, please click here to close your account".

There can not be a clearer sign than that.

I think the link to close your account is just out of necessity since they are changing the original policy that you agreed to.

i doubt they really want to be encouraging any sellers to close their accounts, big or small. They have already alienated most small sellers, in effect turning their backs on the people that made them a success.
It was a bold move to try to attract corporate sellers but not exactly a prosperous one as since implementing those changes share prices fell dramatically, and they still remain a long way from the $40 mark that they used to command, currently bobbing around at $17 or there about.

Perhaps Ebay have something up their sleeve but i think part of their trouble is the contempt they have treated those who pay to use the site with, and the huge biased towards buyers that makes it a safe place to buy but a precarious one to sell. And the fact sellers don’t like having to place themselves at the mercy of paypal who will let anyone issue a chargeback claim for upto 45 days, even if they have a returns policy of 14 days. Or exercise their right not to accept returns on auctions.

For those who would argue ebay's share price has nothing to do with how they run the site and treat their users but is more to do with the recession, i would point out that Amazon have maintained a strong share price currently at $79 and Amazon have actually seen a steady rise in their share price over the last 6 months, pretty much the heart of the recession.

Not really conclusive in these times the markets have fallen by about 50% and they were no doubt overpriced at their peak.

Doh should have read the whole thread before rushing a reply.

Oh yeah, I'd forgotten about this bit- well spotted. :T
Once you have refunded the buyer, your FVF for the listing will be credited automatically to your account – you don’t need to follow the Unpaid Item process anymore. (Remember, to qualify for a FVF refund, you need to refund at least 80% of the item price, excluding postage costs.)
This is my opinion. There are many others like it but this is mine

I am a professional ebay seller. I work hard at my job, I love my job, if you think it's silly that's your problem not mine. :p

ah well, slow to catch on but at least they are getting there.

I am often seen as over critical of ebay on these boards but this is a very positive step, ebay are finally doing what is right with regards sale fees, it should make professional sellers less inclined to try and refuse refunds as they only stand to lose the postage charge now.

OP any news on this? what did you decide to do? accept the refund or fight it?

Yes my case was different and I do agree if a seller was trying to raise funds etc. then it's a damn cheek if someone wants to get a refund after time, but if you state a maximum of 7 days in which the buyer can do so then this may solve this issue. But if you are selling 'new' with tags etc. then surely this isn't just a clear out?

Anyway, I think there has to be a happy medium to keep both sides protected and people selling should use the correct wording in their listings to protect themselves as much as possible.

    :j

Yeah it is, im not a regular seller, its just something that i've never worn before and it still has the tags on..

Hi everyone and thanks for your replys :)

I've just looked at my paypal account and it says that it has been granted - the item was not as described. I dont know if they have gave her the money back..

I haven't had anything in the post yet...
