if you refuse to sign for it paypal will still refund the buyer.
twice now i have returned things to sellers and they have refused them and they've gone to their sorting office
paypal refunded me both times as i had proof that i had attempted to return, as the tracking stated that an attempted delivery had been made and item was at the local sorting office
both sellers promptly collected the items after i had been refunded0 -

I've just had an email from ebay saying they are increasing buyer protection as well.

Why would you not accept returns on clothes anyway? Surely you could allow a limited time on accepting returns.
If a catalogue stated they wouldn't accept returns I wouldn't order from them. No doubt the fact people know their rights with ebay/paypal they still buy clothes off ebay even when 'no returns' is stated!
I recently ordered something quite expensive and electrical, the seller stated 'no returns accepted' and if paypal had gone with this I would have been left something that didn't work (it was either damaged in transit OR the seller was trying to offload damaged goods, using the no returns policy).0 -

your case is slightly different as according to what you say the seller sold you an item that was not what he said it was. Assuming a seller sells something by auction on ebay and what they supply is what they stated, i don't really see why ebay should be able to over rule a sellers exception to distance selling regulations.
This view has proved to be controversial on these boards, but, imagine you were a part time ebay user, struggling for money and decide to sell something of value from around the home to raise some money. It sells, there appears to be no problem, positive feedback is left, you withdraw and spend the money because you need it to make ends meet, only then, a week or so later to be ordered to return the money to the buyer, you can't afford to and end up with debt collectors harassing you.
There is a reason why there are exceptions from certain laws and ebay and paypal should not be able to over rule them in my opinion.0 -
I do agree with the idea that if positive feedback is left a buyer should not be able to put a claim in as they by giving the feedback have accepted the item and its condition

Cyberbob, What do you think about if a seller lists something by auction, regardless of feedback, and it is as described, should ebay be able to remove the sellers legal right not to refund?

Yes my case was different and I do agree if a seller was trying to raise funds etc. then it's a damn cheek if someone wants to get a refund after time, but if you state a maximum of 7 days in which the buyer can do so then this may solve this issue. But if you are selling 'new' with tags etc. then surely this isn't just a clear out?
Anyway, I think there has to be a happy medium to keep both sides protected and people selling should use the correct wording in their listings to protect themselves as much as possible.

I'm not taking any side, or making any claim about any postings, just observing that both buyers made the same statement, and were both treated the same.
So how can you claim one was fair and one wasn't?
No one makes you sell on ebay, but without protection there would be a lot less buyers.0
