Wow well i have been following this thread for a while now,i started up making nappy cakes and gifts in jan i was bought one and wanted to make our friends one and i found it so relaxing and lovely to do that i went from there,i love to see the looks on my customers faces and there has only been one week that i have not had an order.im so chuffed with how things are going.i make towel cakes also.

Lovely cake Vicki. Just a quick question to those of you who do fairs etc. Do you display prices either on signs or put a price on each product. Or do you just tell people when they ask how much? The reason I ask is I did a market stall a few weeks ago but didn't bother pricing anything (i do nappy cakes pamper cakes and quite a lot of other craft gifts) TIA0

I have a question to you I've got a message from one girl here it is:
hi, to everyone who makes nappy cakes. I am just starting to make nappy cakes myself and i must warn all of you, to contact trading standards asap. I have done this and they will be visiting me very soon. But they have said to me that you cant just make them up and sell them, you need to follow trading standards guidlines of listing every item, each item have addresses and some have ingredience, like shampoo for example.all of these have to be listed. There has to be warnings if there are choking hazards, like cellophane and safety pins.
Also if you are taking things out of packaging to put in the cake, you could be breaking copyright rules, so i really advise nappy cake makers to talk to their local trading standards first.
I would also recommend to go to direct line and buy business insurance, which is just over £50 for the year. If anything happens, you can be sued, so you must cover your backs
Have you done this? I have insurance but did you contact trading standards? Do you write all this where the ingredients are?

I list the ingredients although all the bath products have their own ingredients list. I also state that some products may be unsuitable for children like any artifical flowers or small bits that could be swallowed. Trading standards only provide guidelines and are there to investigate complaints. I think as long as you're sensible about things and assess and minimise any risks you will be ok. Not sure about the copyright thing, I'm guessing it would refer to branded products like Disney.
I have products insurance and insurance to be a market trader to cover me at fairs etc.
I do think the world is going mad sometimes with all this sueing business, its very sad!!

What about Baby Baskets, for instance, that are on sale in shops. My local Chemist always has some for sale made up individually.
Ingredients are on Toiletries, washing instructions on labels on clothes and toys.
I could see there might be an issue taking things out of packages such as teethers where the instructions are on the packaging. Where does that leave us, taking nappies out of packaging?
I think you could argue that it goes for most things on sale by "craftspeople" We take things out of packaging to make into something else!
On the subject of warnings for "choking hazards" etc. It's a good idea to put a disclaimer in the cake but I think as long as people are sensible and keep any such items to a minimum, then that should be fine.
(We have all struggled to take a new toy out of it's packaging, and ended up with a pile of plastic ties etc)
I know there might be an issue with the fact that the cakes are for babies, but they are actually gifts intended for the mothers. You wouldn't expect a baby or young child to unwrap the cake so I think "Common Sense" should be the word.0 -
