twirlie, does your order specify an amount or a percentage per month, if its a percentage your payments should automatically increase if Texas have issued an IWO. It took another 3 months but my arrears are now being collected through his IWO.0

My problem is my daughter came to live with me just under two years ago as she was unhappy living with her mother. Her mother was against this so my daughter ran away to live with me. My daughter had been dragged around the world before moving back to the UK and when she returned asked her mum if she could live with me as she didn't want to move abroad again. Her mum has never paid anything for her and still refuses to even though I am disabled and my new wife is my carer so we live on benefits. This means our daughter is not getting everything she really needs. The problem is her mum is married to a wealthy man with a good job so she does not and although he was willing to take her on and pay for private education at the time she lived with them, she won't pay. We are going to have to move soon as our rent is too much and the only place we can afford is 30 miles away which mean a change of school for my daughter at a critical time because she will start her exams soon. We have tried to put this off but it's now become inevitable. The CSA won't do anything as my ex is not working even though she owns a million pound apartment in Singapore which she rents out. This is really causing problems in our household as you can imagine my daughter has friends and also does not want to move schools again, what can I do?0

Hi,
I have just found this thread after starting going down the REMO road. There has been no order or agreement in place previously, but it had got to the stage where I wanted my son to have some financial input from his father. I went to the local magistrates court in December 2011 to swear in all the documentation, and had a confirmation letter from The Official Solicitor in January 2012 to inform me that my paperwork had been transmitted to the courts in the US (Florida to be precise). Having read some of the previous posts I realise that this is fairly quick work.
At the beginning of this week I received an e-mail from my ex informing me that a paternity test had been ordered. I understand that this can be done without having to travel to Florida for us all to be tested together. Can anyone confirm or advise.
He has also been 'advised by his legal counsel that I will be compelled to attend a trial in Florida'. Is this correct? I think that he is either bluffing, or his legal counsel is not aware of the Reciprocal Enforcement Maintenance Order (if any of us are :rotfl:.?)
Any advise would be really appreciated as I once the paternity test has come back then the Department of Revenue in Florida should just order the support to be paid surely...?
Yeah - so glad that I have found you!!!!0 -
I was wondering if anyone has experience the other way. My ex has moved to the UK and has stopped paying his court ordered maintenance. Does anyone know who to contact? I have tried CAS and they say they can't do anything as I am not a UK resident.0

Maybe you should try to open an account with a bank that is not a virtual bank like HSBC. They are really just a credit company. Try Bank of Montreal, Toronto Dominion Bank of Canada, Royal Bank of Canada, Scotia Bank or a credit union0

I was thinking about your banking issue. The regular banks may not allow you to open an account on line. I would suggest you go on line and open an account with either President's Choice Banking or with ING-Direct. Both are Canadian and both allow opening accounts on line.0

HELP!!!
I have just tried my magristrates court to apply for a REMO and they passed me on to the County Court.
My ex husband is leaving for america and has kindly told me he wil no longer support his son as the government will do that.
I cant afford solicitors and hoped to do this myself. i have no court order as it was through the csa.0 -
I do have a consent order but it was made in the county court so my application to the magistrates court was rejected and I was redirected to the county court.
The magistrates forwarded me a couple of pages with paras highlighted, which I can't find but this is the Judge's instructions in the covering letter so you might be able to find the info online or at the library.
"send the applicant a copy of pages 114-118 of the 2010 family court practice which sets out the procedure to be followed. particularly important is the documents to be filed to be found at the top of page 115 and applicability to the USA to be found at page 117."
The procedure is similar to an application to the magistrates except you need an affidavit. I had a go at writing it myself using a 'general form of affidavit' which I found online. I answered all the points listed in the highlighted para which included where he lived, his employer, date of birth and a photo but decided to go to a solicitor so I knew it was right. She took my draft and threw in a few legal terms but I think I'd have been ok with my version and £200 better off.
She told me to go to the public counter in the magistrates court to swear the affidavit, then I went and had a couple of copies made before going back to the magistrates to submit the affidavit and pay the £40 fee, it really was that easy.
8 wks later the original judge signed my paperwork and it was sent to REMO and 4 months later I started receiving weekly payments from America.
What type of visa is your ex going to America on? Mine paid voluntarily while he was applying for his green card as he knew it would be denied if he didn't and he restarted making voluntary payments before the deductions from his pay started when I sent him a document stating his visa and driving licence could be revoked for non-payment of child support.
Good luck0 -
Hi people,
just looking into the REMO process as i discovered it today, why on earth do CSA not provide this info when they shut down my claim because my ex moved back home to nigeria?!
any advice on costs im going to incur with this would be a big help and obviously things not to do, by the looks of this thread its going to take me a good few years and my daughter is nearly 3 and he hasnt paid a penny since she was 1!
do you need to have been married to your child's father to do this?
do i need to provide them with a current address for him as i have no way of finding this out?
I cant wait to start this off and see where it goes
Also... can i appeal to have my CSA case reopened and left open untill REMO process has taken place?
sorry about all the questions!
oh and does the father have to be in contact with the child as he isnt doing that either!0 -
Hi all,
My ex moved abroad three years ago, New Zealand. I started the Remo process.
Now from there end they are saying that I can only claim a maximum of £1000 per child.
Can anyone tell me if this is correct please?(the money he would have been paying if he still lived in the UK is alot more)
