Just got a phone call from my solicitor on the house I am buying,(was repossesed back in July 2009.)
Concluded our purchase on Wednesday 24th November, moving in on 3rd December ( a week today). Mortgage paper etc all signed, was booked to go in and sign the deeds on Monday.
Apparently on Wednesday there was a 'landmark' supreme court ruling which will affect EVERY repossession property in Scotland!!! this came out 'after' I concluded, although have been waiting on an acceptance letter to arrive from selling solicitor.
have just been informed by the selling solicitors that due to the recent ruling our purchase is now 'pending'. so we could hand over the keys for our property on Friday and have no where to go!!!!!!
f***stix!!

going to be a long weekend getting stressed out again!:mad::mad::mad:0 -
todays update, The bank are not proceeding with the sale of the property I was due to move into on the 3rd!. they have to check all the repossession paperwork was correctly raised in regards to the court case mentioned above.
SO, have to be out on friday ( as new owner moving in), and I have to find somewhere temporary by friday!, the paperwork cehcking could take anything from a day upto 3 months depending how it was done.
I thought we had all this sorted out and now stuck in a dilemma as to what to do and where to go!
YIKES..
I was told I do have the option of pulling out but it is the house im after, have even requested if they would entertain me renting the property ( as its sitting empty) until the paperwork is all sorted out.
I must say im in a nightmare situation!:mad:0 -

Oh no, balderdash...
I think you've either got to call on favours from relatives or find a place to rent...Where is it you're moving to again?0 -
hi again NEH,
was planning to move to Macduff, no relatives up here , but my boss is going to see if he can pull a few favours. as long as its within 30-45 mins of Fraserburgh, minimum 3 bed , must allow cats. etc etc. at wits end and having a very down day.
how is your sale going in Aberdoom?0 -

:rotfl:
Thanks, our Solicitor bascially told us don't bother with it anymore as studios and 1 beds aren't selling and won't be...
We're getting it ready to rent out but at the moment we have a washing machine that needs to get down the A96 and the snow won't let us...:rotfl:
We've also got to find a good electrician to replace the storage heater but we haven't found one in Aberdeen yet...0 -
Well my 2 viewings on Saturday were mixed. One couple loved the place, ticked all their boxes, although they have a house already to sell. Other couple were very dismissive of the place and then asked me was I open to low offers. I think they were more keen on seeing how desperate I was to sell in order to get a rock bottom price.0

Got a second viewing on my house tonight apparently. Its the first one where I cant be there, so the EA is doing it on his own. Bit worried to be honest, as I dont like the thought of someone wandering about my house when im not there. Things like, will the EA make sure they take their shoes off, and will they leave things how I left them etc. Will they lock the garage up correctly etc..
Also worried, cos the house will be freezing cold and not "staged" nice and cosy with lights on etc how I normally have it.0 -
Okay, so feedback from 2nd couple is that he loves the place, thinks its perfect. But she doesnt like it cos its an older house.
But, have had an offer from the 1st couple, at 10% less than what id actualy accept - and the same price as the one a few doors away sold for 6 weeks back needing total renovation and no garage. The guy even said that my garage would cost about £25k if he had to build one, which is why he was attracted to my house.
So, ive gone back and told them to revise their price. They want a 2nd viewing at the w/end, so fingers crossed that helps them increase their offer.0 -

Best of luck to you, fingers, legs and everything else crossed!0 -
Thanks.
No luck at the moment. The viewers who made the initial offer have others to look at in the area.
Ive now decided to change Estate Agents. The current lot havent done much really over the last 3 months - ive only had about 3 or 4 viewings and they just dont seem pro-active enough. I keep having to chase them all the time. Another agent is very keen and must have phoned me once a week since my house has been on the market touting for my business. So, I will give them a shot I think and see how they compare.
Im sure all the EA`s are as bad as each other, but I dont think ive got anything to loose.0
