I would have thought the whole "Additional Services" argument from T-Mobile would work if you could get that service from someone else, but when you have to get it from T-Mobile then surely the distinction is irrelevant.0

Come on hemmy1 ....
Have they replied to ya claim - as it's close to the 14 days now...
CISAS are taking ages just to process my claim - i'm considering just putting in for small claims on monday..0 -
Gone the small claims court route. Rung up CISAS to cancel it from being processed.
Just submitted my claim.. 14 days.. tick tock.0 -
My small claims application has now been issued – T-Mobile should receive it tomorrow. So by the 12th of August – if they haven’t replied, i will file for judgement.
I will let people know if they intend to defend or confirm they are willing to pay / settle.

I had my initial written reply the other day. Just said the usual, nothing more to report. However it seemed to claim that the text I was sent only gave notice for the 1st Aug change, not the roaming charges change the day before. Which is a load of rubbish.0

Lasest reply from them:
Good afternoon
Thank you for your further email regarding the EU Directive and our responsibilities as a provider.
I'm sorry that you're unhappy with my response and that you'd still like to close your account.
However, I've already consulted our legal team on this matter, and as I've said you aren't entitled to close your account without charge. While this directive may apply to us, the change we?ve made was not to your terms and conditions.
Roaming calls are an additional service, and not one that we're obliged to provide. We can change the cost at any time, and this was made clear to you before entering into commitment. It?s your responsibility to check the terms and conditions of our agreement.
If you wish to consult third party advice on this matter, you're free to do so. We'll cooperate and provide any information that is requested.
Unfortunately, in the meantime, I'll be unable to expand on the information I've given. I've already investigated the matter thoroughly and consulted with our legal team. If there was anything else we could do to help you, rest assured I'd have already offered this.
Thank you once again for taking the time to contact me Mr Mehat. I know this isn't the answer you were looking for and I'm sorry.
Kind regards
Do you think I should apply through CISAS now and see if there's anything they can do?
Thanks0 -
yes, go through cisas, see what they say.
anyway after cisas you still can go to small claims court0 -
Isn't it astonishing that on teh one hand its not part of your terms and conditions yet on the other jhand they tell you its your responsibility to check them !
I'd go small claims court - as others haveTANSTAAFL !0
