    We have setup a group to tackle the issue of Sunday Solutions/Bradbury etc and are considering group legal action. Currently there is about 15 of us and the more people we can get involved the better. To aid this we have setup a private wiki, and we are vetting any people who want to join us to make sure everybody is who they say they are.


    If you want to get involved then drop a mail over to [EMAIL="sundaybradbury@yahoo.co.uk"]sundaybradbury@yahoo.co.uk[/EMAIL] with some info about yourself and explaining the situation you are in.

    The info other people have sent is as follows:

    · Contact details - please include skype as this is a good method to allow other to talk as a group and is free
    · What Partnership you were in.
    · Something to confirm the link to the partnership /Sunday - Some have sent a copy of the partnership contract
    · Something outside of Sunday/the partnership - some have sent a CV but a little about yourself and what you do will be enough.
    · Any online presence if applicable - some have websites etc.

    I'm also affected by the same problems as posted here by other people. I've only done a small amount of work through the Sunday Solutions arrangement and I'm fortunate in that Bradbury have paid my tax - in fact I even got a return from HMRC!

    The problem I'm facing is that Bradbury has an over-retention of funds set aside for tax. This, I have been trying to get back since January this year. Of late Bradbury insist, it's not their responsibility to administer the partnerships but it's down to Sunday. When I spoke to Sunday, they said they would try to sort it out but they never did.

    Having tried to contact Sunday and Bradbury over the last few days has resulted in answer machines which have full voice mail systems. I also note that the Sunday website appears to be offline. I've sent an email to one of the directors (Andrew Nyiri) personal mail address - but somehow I doubt I'll get a reply.

    You may also be interested to know that others outside of this threat are affected by this issue and the thread can be found at contractor UK (I can't post a link as the system won't allow as newbie to do so)

    There is mention on there of a group being set up to try and recover what's owed to people - might be worth getting in touch.

    p.s. - yes I'm new here and so have a low post count too - thanks to Google and my search of "sunday solutions problems" - I found this post!
  • I too have been fighting with Sunday and it's partners....

    Sunday changed accountants to Bradbury and Co. Ltd (NOT to be confused with Bradbury and Co Accountants, the ACCA registered company). This Bradbury & Co. are not a member of ACCA (Association of Charted and Certified Accountants), so you have no registered body to complain to when something goes wrong.

    Sunday recommended I have B&C complete my tax return, for a fee, as they are doing the partnership accounts and would have intimate knowledge of how it all works etc etc. Sunday then filed my tax return for me a few months ahead of the deadline, stating that the 'pot' they keep aside from my earnings for estimated tax payments was £300 short and I needed to pay the little extra. Not too bad, so I paid it. A few months later, I get a nastly letter from HMRC saying I owe £7000 tax which is now overdue. If I don't pay now, I will be fined and risk having a bad credit record etc etc.
    One small heart attack later, I get on the phone to Sunday who eventually say it has all been handed over to B&C to deal with and that I must deal directly with them. So much for a personal business manager!
    Three emails and 7 phone calls later, I finally get phone back by Andrew Nyiri at B&C who explains that Sunday c*cked the whole thing up and didn't calculate the partnership profit correctly, so it must all be redone. Good news is that I should get some tax back, bad news is that is will take another month to sort out before paying my HMRC bill. They promise to contact HMRC and sort it all out and Sunday agree to pay the fines and extra interest. fair do's.
    A month goes by without hearing anything. Another nasty letter from HMRC about still not getting paid. Send a few email to B&C, still no reply. Phone them 14 times over 8 days and left 5 messages, including phoning the mobile phone of Andrew McIntyre, who is dealing with my accounts. No reply, no answer and no call backs. I check with my friend and he is exactly in the same boat as I am. His outstanding tax bill is even higher and he has been trying to speak to someone for the past 3 weeks with no success.
    Finally get a response from them and my new tax return is completed and submitted. This in now the 3rd of JUNE 2009 for my 2007-2008 tax return!!
    Is this the end of it? No chance!
    It is now the 26th of August 2009 and my tax bill is still outstanding, it is accruing interest at 50p a day, I have had two sets of fines levied by HMRC for £227,58 each added to the interest and penalties already on the account and I still have no sign of a refund, nor a response from Bradbury and Co.
    I contact them on a daily basis, emailing Andrew Nyiri and Andrew McIntrye on each on them. I have sent around 45 emails and have received a total of 4 replies over the past year that I have dealt with them. I have only once, in all that time, managed to speak to someone on the phone. Not a single one of my messages to please return my call have ever been responded to (by anybody in the entire Sunday group!).
    Sadly my formal letter of complaint went to the wrong Bradbury and Co., who did respond very quickly saying that I, along with many others, have written to the wrong firm and supplying the details of the correct firm to contact. Clearly they have had to deal with this enough times to have all the other companies details to hand.
    My friends letter of formal complaint went to the correct company, but as they said in their reply to him, they are not a member of the ACCA and as such do not have to answer to them.
    So, here I am now, with a huge tax bill that is still outstanding and accountants that are holding onto £7000 of my money and refusing to pay my HMRC bill with my own money and there is Sweet FA I can do about it!

    Bottom line: Rather chew your own arm off than ever go near Sunday Solutions or Bradbury and Co. Both have the Tramshed address in Bath, so easy to recognise.

    I hope this helps somebody out there and prevents you going through the stress I have just gone through - and still am!

    For those that don't believe me, check out companies house for bradbury and Co. (See below) - they can't get their own accounts in on time, what chance do they have of getting yours in?

  • Like the rest of you I am having problems getting money owed to me and paying HMRC. i had no problems with Sunday Solutions but I did stop using them Jan 2008. My problems have been since they passed my accounts to Bradbury to do my tax returns since then nothing but problems. I have spoken to local trading standards and been informed they have moved or the head office is in Folkestone. I have sent letters to them there and they have been signed for but still no response. talking to HMRC today they told me if everyone who is having a problems with Bradbury writes to them they will investigate. I have also spoken to my local police station and they said there may be a case for fraud but that I would have to go through CAD or solicitors before they could get involved

    Since my last post, I joined the Sunday Action group mentioned by Dandcg and I can recommend you do to. They are very organised and have already started legal proceedings against both Sunday and Bradbury (both owned by the same person!) and have a group case number open with the police (Fraud squad).

    As you mentioned, HMRC will only help if enough people complain, and this seems to be the best way to do it. They have over 30 people already and the more that join, the more clout we will have.

    They have tons of info and I wished I had joined earlier.

    I understand your concerns but I am one of what appears to be many who trusted Bradbury and Co and Sunday Solutions to provide services when self employed. Unfortunately for whatever reason monies have been paid to them or as in my case retained to meet our tax liability but now find that this has not been done. There may well be good reasons for this but when a company does not reply to phone call, emails, normal mail and even recorded delivery letters that have been signed for I for one would like to know, as I am sure you would if you were in the same situation. Like me many people would have searched the web for details and ended up with this forum thus meaning low post count. So please don't be so quick to jump to conclusions not everybody in this world is out for what they can get.

  • Not sure how relevant this is but Bradbury have filled accounts for last year with companies house, does this mean they are trading in some way ?

    My past Situation with Bradbury and Co:
    After months of fighting/chasing Bradbury and being chased by HMRC, I eventually got Bradbury to pay HMRC my required tax payment using my money they had in their account. This included the overdue payment fine.

    My Current Situation:
    After being told that all partnership accounts would be finalised in August and refunds made back to each partner, I am still waiting. I spoke to an account their 3 weeks ago who confirmed they are busy processing the accounts but after repeated calls and e-mails to Bradbury to follow up on this I have had no response at all.

    I have joined the group mentioned above by dandcg but I am not sure where this will lead though.

    Expected Outcome of this post:
    Not sure really, just wanted to add in my situation in support of all the other posts.

    Police are indeed involved and yes legal action is currently underway. That's all I am able to say at the moment. But I write this as a warning to others who maybe thinking of using Bradbury's 'services' and advise to switch accountants as a matter of urgency.
