    It would be nice if everyone could learn a lesson from this.

    1) Anyone can call themselves an accountant or accountancy firm. You are taking a huge risk in using one that isn't regulated by either the ACCA or ACA.

    2) There is no reason for your tax agent to collect your tax money and pay it to the HMRC on your behalf. We act as agents for all our clients but not one penny of their money passes through our accounts.

    3) I have no idea what this firm's fees were like but often the unregulated accountants are working right at the cheapest end of the market. There's a reason why cheapest is not the best option when it comes to professional services.

    [TEXT DELETED BY FORUM TEAM] Sunday Solutions changed it's name to Reed Umbrella in February 2009 during the time Von Essen 'acquired' the contractual obligations of Sunday Solutions-when VE started to drop all their acquired consultants, they reccomended Reed Umbrella. You'll also find that the key players are all ex-Sunday solutions-the list is endless! My advice to you would be to take back control of your money asap-get yourself a good accountant and go ltd.
    I recently called HMRC about this and explained that Sunday Had said their charges wre 7% and I was worried because they were more.
    The guy at tax office said most umbrellas should be charging clients less than 7% and they would possibly want to know what was provided for the extra costs. It seemed high to him. He actually said they'd ask for the invoices for the fees because the partners will have prove they paid them.
    Now someone says Von Essen was walking off with 20%. What for ? That should get HMRC interested in V Essen too do you not think?

    I had an email from these guys too, looks like they got the mailing list from one of their connections. What is it with Bristol, is it where all the fraudsters live!!

    I am looking for some advice. I have just made a phone call to HM RC regarding a tax rebate and they informed me that Sunday Solutions/Bradbury/Willowmead have not completed my 08-09 and 09-10 tax return. I googled their details with the aim of finding their contact details and came across this forum. As you can imagine and am both shocked and extremely worried.

    Can someone provide me with any recent information about any legal action that has been taken against Andrew Nyiri? I have emailed one of the groups set up but have has no reponse yet.

    any information and/or advice would be appreciated.

    I am one of the group coordinators for the action groups.
    I am also looking after potential new joiners.

    To bring you up to date a little, the action is ongoing and not expected to be resolved any time in the next 12 months.....long battle ahead.

    The reason we are able to sustain the action is that we have strength in numbers, obviously there are legal fees involved, but spread across all groups these are manageable.
    There are no guarantees however. But we remain confident of a positive outcome to our case.

    From there you will be sent a document pack to complete and return. After that point you will be asked for a commitment, this will involve a financial outlay but it is not prohibitive and you will be given an idea of the costs involved moving forward. Again, the more involved the cheaper the costs per person.

    Umbrella tax companies taken out of service
    21 December 2010 15:00
    Insolvency Service

    Following an investigation by The Insolvency Service, two companies Sunday Solutions Limited and Bradbury & Co Limited, each involved in a tax umbrella scheme called the Sunday Solutions Scheme, for self employed consultants, have been ordered into liquidation in the High Court on grounds of public interest.

    Company Investigations found the scheme was marketed to prospective clients, mostly IT consultants, as a partnership whereby their tax liabilities would be deducted from the income collected for them and then be retained in a partnership bank account to pay their taxes when due. An estimated £80 million was handled by the scheme but many of the 1500 consultants who used the service did not have their tax liabilities paid and remain liable for the unpaid tax.

    The directors of the companies failed to fully co-operate with the investigation which identified over 100 bank accounts, ostensibly opened for each of the so called partnerships. In addition, the scheme was marketed to prospective clients as a membership of Limited Liability Partnership but no LLP names were registered at Companies House. The investigation also found that excessive and arbitrary fees were levied for the service, in some cases up to 30 per cent of a client’s earnings.

    Numerous complaints were made to the companies by clients. As no action was taken to address their concerns, an action group, SundayBradbury was formed by disgruntled former clients.

    In ordering the companies into liquidation Ms Registrar Barber said that whilst the companies do not admit the allegations, they do not oppose the winding up, and that she was satisfied for all the reasons alleged by the Secretary of State that it was expedient in the public interest that the companies be wound up on grounds of public interest.

    Commenting on the cases Investigations Supervisor Chris Mayhew said:

    “Anyone considering using an umbrella tax scheme needs to be confident that they are using a reputable company. The action taken in this matter sends a clear message: if you run a company that adopts unscrupulous business practices, we will investigate and where necessary take action to close them down”.

  • Winding up orders were made against Sunday Solutions Ltd and Bradbury & Co Ltd on 15 December 2010 in the High Court. The petitions were presented in the public interest by the Secretary of State for Business Innovation and Skills following an investigation under the provisions of section 447 Companies Act 1985. The Official Receiver at Public Interest Unit [London], The Insolvency Service, 21 Bloomsbury Street, London WC1B 3SS is the liquidator. Creditors of the company should note that all claims should be addressed to the Official Receiver.
    In the first instance the Official Receiver’s priority is to establish contact with all creditors of the companies. Please note that at present the Official Receiver is not in a position to discuss the particular details of any individual’s contract or dealings with the companies. The Official Receiver’s Report to Creditors will be issued to all known creditors within 8 weeks of the date of the winding up order and will contain details of the currently known position.

    It is likely that we will need further information and documentation from you in due course, but please do not send it in until requested. If any financial distribution is to be made to creditors in the future, the Official Receiver will write to all known creditors to notify them of the fact.

  • How you came to Sunday Solutions could make a very bigdifference to you. This is because some of you were referred to them byregulated individuals. ie financial Advisors of Sunday IFA then you cancomplain to Sunday IFA Ltd that this was bad advice on the basis that SundayIFA did not carry out sufficient due diligence on the company that they wererecommending. That the advice they gave you when you were a client of SundayIFA was incorrect for your circumstances. If you feel that either or both ofthese was the case in your individual situation. All you have to do is phone01985 211444 and make a complaint that you were wrongly advised to do businesswith Sunday solutions. They will probable refuse your claim for compensation inwriting after a few weeks and then you can complain to the Financial OmbudsmanService just type in to Google. Then you only need you to fill in a 4 page form which is very simple and easyand send it off for the Ombudsman to independently investigate your case.



    Will it work? I don’t know, it may depend on how manycomplaints that the Ombudsman receives and whether the actions of Sunday IFAwere wholly inappropriate warrant reporting to the FSA. It might take you agrand total of 1 hour to do both of these actions but then if you get back thethousands of pounds that you lost it could be the most productive hour of youryear.
