I agree, I think we need to push for what we are owed, the trouble is the short term HMRC payment.
One thing I would like to understand is my legal position if I accept the accounts, receive my money and then want to challenge the fees afterwards? By accepting the terms would I affectively nullify my right to appeal legally and not be able to take legal action?

Hi Fico,
I am looking for an accountant too. I am sure people might have already found someone who's able to sort this mess up.
Cheers MC.
MC I found a chartered accountant who knows the situation and can help. I will PM you their details but you need to contact them ASAP to meet the 31st January deadline.0 -
I've heard that the communication that we should of received week commencing 14th Dec, should now arrive tomorrow by email !!!!
It's already been 6 months of chasing, what's another day!0 -

Now I have these at least I can get an accountant to complete my 08/09 tax return but what about the money owed to HMRC for the partnership. Are Bradbury paying this? Is the only tax return I need to take care of myself my personal one or is there anything else I need to do to make sure I am covered and all tax is paid?
Thanks
Iain
no Bradbury are not doing anything . You could try talking to someone independent.0 -
Pls can anyone help me with the contact details for Bradbury & Co especially people that are in correspondence with them. I left the partnership in October 2008 but need to submit my tax assessment for the period 08/09 which unfortunately was handled by Bradbury but I havent been able to get intouch and reading through the thread I can see why and very upset and distressed at the grief I will soon get from the HRMC.
All I need is for them to send my the partnership details so I can submit my assessment at least for a start because from my record they held back more than £14k to pay the tax man.
Your quick responses is appreciated.

Sunday changed accountants to Bradbury and Co. Ltd (NOT to be confused with Bradbury and Co Accountants, the ACCA registered company). This Bradbury & Co. are not a member of ACCA (Association of Charted and Certified Accountants), so you have no registered body to complain to when something goes wrong.
Sunday recommended I have B&C complete my tax return, for a fee, as they are doing the partnership accounts and would have intimate knowledge of how it all works etc etc. Sunday then filed my tax return for me a few months ahead of the deadline, stating that the 'pot' they keep aside from my earnings for estimated tax payments was £300 short and I needed to pay the little extra. Not too bad, so I paid it. A few months later, I get a nastly letter from HMRC saying I owe £7000 tax which is now overdue. If I don't pay now, I will be fined and risk having a bad credit record etc etc.
One small heart attack later, I get on the phone to Sunday who eventually say it has all been handed over to B&C to deal with and that I must deal directly with them. So much for a personal business manager!
Three emails and 7 phone calls later, I finally get phone back by Andrew Nyiri at B&C who explains that Sunday c*cked the whole thing up and didn't calculate the partnership profit correctly, so it must all be redone. Good news is that I should get some tax back, bad news is that is will take another month to sort out before paying my HMRC bill. They promise to contact HMRC and sort it all out and Sunday agree to pay the fines and extra interest. fair do's.
A month goes by without hearing anything. Another nasty letter from HMRC about still not getting paid. Send a few email to B&C, still no reply. Phone them 14 times over 8 days and left 5 messages, including phoning the mobile phone of Andrew McIntyre, who is dealing with my accounts. No reply, no answer and no call backs. I check with my friend and he is exactly in the same boat as I am. His outstanding tax bill is even higher and he has been trying to speak to someone for the past 3 weeks with no success.
Finally get a response from them and my new tax return is completed and submitted. This in now the 3rd of JUNE 2009 for my 2007-2008 tax return!!
Is this the end of it? No chance!
It is now the 26th of August 2009 and my tax bill is still outstanding, it is accruing interest at 50p a day, I have had two sets of fines levied by HMRC for £227,58 each added to the interest and penalties already on the account and I still have no sign of a refund, nor a response from Bradbury and Co.
I contact them on a daily basis, emailing Andrew Nyiri and Andrew McIntrye on each on them. I have sent around 45 emails and have received a total of 4 replies over the past year that I have dealt with them. I have only once, in all that time, managed to speak to someone on the phone. Not a single one of my messages to please return my call have ever been responded to (by anybody in the entire Sunday group!).
Sadly my formal letter of complaint went to the wrong Bradbury and Co., who did respond very quickly saying that I, along with many others, have written to the wrong firm and supplying the details of the correct firm to contact. Clearly they have had to deal with this enough times to have all the other companies details to hand.
My friends letter of formal complaint went to the correct company, but as they said in their reply to him, they are not a member of the ACCA and as such do not have to answer to them.
So, here I am now, with a huge tax bill that is still outstanding and accountants that are holding onto £7000 of my money and refusing to pay my HMRC bill with my own money and there is Sweet FA I can do about it!
Bottom line: Rather chew your own arm off than ever go near Sunday Solutions or Bradbury and Co. Both have the Tramshed address in Bath, so easy to recognise.
I hope this helps somebody out there and prevents you going through the stress I have just gone through - and still am!
For those that don't believe me, check out companies house for bradbury and Co. (See below) - they can't get their own accounts in on time, what chance do they have of getting yours in?

The only phone number and email address I have is 0844 800 4178 and info@bradburyandco.com
I have sent over 20 emails but not a reply, and the phone number is just an automated message.
I have been trying for the last 6 months to get something out of them but nothing. I am hoping to get something tomorrow via email.0 -

How did you know you might get an email tomorrow. Did someone contact you to that effect?0 -
My current umbrella company, Fleming Laing, who took over most of Sunday Solutions clients told me this morning. But they also told my Bradbury were going to email on Friday so don't hold your breath!0

Guys,
If you were contacted by a different Umbrella Company after Sunday Solutions/Bradbury then you are most likely to have all your tax assessments sorted before the due date.
If you are with one of the Umbrella Companies that contacted you 'Out of the Blue' after Sunday/Bradbury, please contact them and ask them to do your 'Tax Assessment'. Don't be surprised if they don't ask you for any details of your 'Partnership Accounts'.
My personal experience is that the company that approached me after Sunday Solutions and Bradbury, have all my partnership details. So they are sorting out my 'Tax Assessment' for the period I was with Sunday/Bradbury.
The only people who need to be chasing Bradbury are the people who decided to leave Sunday/Bradbury to start their own limited company or decided to use some other Umbrella Company which has nothing to do with Bradbury.
I guess all our 'Partnership Account's' have already been prepared on the 6th of November. I think they are sending the accounts in batches to see if we approve them. They are trying to adjust their scam amounts based on the Approval/Rejection.
I hope this helps.
Cheers, MC.0
