I took back a faulty mobile to my local Orange shop,I was told that I wasn't entitled to a refund as I had had the phone 29 days which was a day over the store 28 day policy. The only thing they could do for me was offer a repair, I accepted begrudgingly because I didn't think I had a choice. The date I took my phone back was the 21/10/04 today after all this time I am still without a phone.I have talked to my local C.A.B & have tried to contact Trading Standards who have been impossible to get through to on their helpline.Since first contacting the Orange shop I have wrote to head office & tried to get my money back with no luck, they are offering me a different phone or my old one with £20 credit.A few weeks ago I went to the shop again to get a replacement, all the phones in the store were more money than I first paid out for the original phone(£79.99).I asked for a phone which is available to buy on their website for £79.99 but they didn't sell it in the shop,so Iam still without a phone. What do you suggest?Any ideas would be greatly appreciated,thanks.0

Can anyone help please?
2 months ago, i bought something over the internet.
It arrived by courier which i signed for.
It was a xmas present for someone so i didnt open it and check it but i put it straight in a cupboard. I recently got it out to wrap and discovered it has dents in.
The company i bought from will not take it back as they say i should have checked it over as soon as i received it and reported it then, and that anything could have happened to it in the last 2 months while it was in my posession. I wondered how i stand with this, do i have the right for a refund/replacement?
Thanks in advance0 -
A bit complicated! Check to see if theres any damage other than packaging0

whenever receiving goods from a courier always sign "unchecked/unexamined" it will help in the long run especially if the sender has the goods insured some couriers dont like this so i sign DAMAGED its a precautionbe happy!0

I had a CD autochanger on my car repaired under car warranty about 8 months ago and repaired again (different fault) again under warranty 6 months ago (this was the earlest they could do the repair although the failure happened on the last day of the warranty). The part replaced at 8mths has now failed again but the vehicle is now out of warranty.
The car makers, Daewoo, refuse to do anything about it saying in their latest letter 'Unfortunately your vehicle is now 7 months outside the warranty period and is therefore out of our parameters for financial assistance with any futurre repairs to this component. As a manufacturer we have upheld the terms and conditions of your manufacturers warranty..... I thank you for allowing us the opportunity to clarify GM Daewoo's full and final position on this matter'
What redress have I got since the part fitted does not seem to have been fit for purpose or of merchantable quality since it only lasted 7 months (facts that I have already pointed out to Daewoo)?0 -

I don't know the law, or ins and outs of this, but as far as I was aware, if you had the fault fixed within the warranty period, then this has it's own 'warranty'. I seem to recall having a fault repaired on a car (can't remember what now) whilst in warranty and was told that as long as the vehicle is within warranty when the fault is flagged, then it's covered.
Surely if you have something repaired 1 day from the expiration of the main warranty, you can reasonably expect it to last 12 months? Certainly more than 1 day. Give 'em hell, I say.0 -
what would be the position if you sent an item to someone and when they received it , it was damaged and the company say well it wasnt signed unchecked, but it had been brought to the drivers attention ,this has happened to me with an item i sold on ebay and one more thing it was signed for by a neighbour too.0

I am having a problem with Orange. We upgraded our 7 company phones in October, less than 3 months ago. Three of the seven headsets supplied in the box with the phones directly from Nokia.
When I tried to return the headsets for a replacement, the shop staff kept repeating that they were not responsible for the headsets, and to return them to the manufacturer. I tried to refer them to the Sale of Goods Act, that they were responsible for the goods that they sell, not the manufacturer, but still got the answer that they didn't guarantee the accessories.
I even threatened the shop with Trading Standards, they said fine!!!
I am not prepared to go through the hassle of sending the headsets to Nokia, and waiting forever for them to return them to me.
I wouldn't mind, but we have a total of seven phones and have been customers since 1999. By the way, I have threatened to move elsewhere at the end of the contract, and they are calling my bluff. To tell you the truth, I can't face the hassle again that we had from Cellnet when we moved to Orange."Excuse me, this expires today, will you be reducing it?"0
