I have a big appeal tribunal coming up & fairly worried stressed as you can imagine, but luckily for me many years ago I had to go to one for an overpayment of 48.00 paid in Child benefit after my mum had written to say I was hospitalised sent my books back they sent payments that were paid straight into my a/c had no idea what for until I left hospital & saw my b/a balance, some weeks later got told I had to pay it back I disputed it it went to tribunal could we find that copy of that letter no on the day of the tribunal my mum entered the room put it in front of me oh you found it! 3mins must of been the quickest tribunal on earth,if you have the evidece try putting it in order you can win,...always write to the L/A DWP & TAX MAN & any one else a phone call is use less unless you ask for the person name & keep notes
I am not sure what you are saying but my main points on this thread were that tribunals are usually fair and independent and it is only a minority of people who do have problems at appeal.0 -

DLA has nothing to do with ESA, they are judged very diffrently and many people who claim DLA also work.
Please can you ake the caps lock off, its very rude to shout at other MSE`s0 -
Went for my tribunal today, passed no probs, really impressed with how INDEPENDANT they really are . Only the judge and doctor there ,but they were both fine, I represented myself and went from NIL points to getting everything including all the extras. So I can only speak for myself as I had lost the will to live with it all, lol, and wasnt even going to go after reading some of the cases on here, but I would suggest everyone has a go as you have nothing to lose, would be willing to offer any help to anyone else and great forum0

I failed my medical assessment in december & have only just recevied my tribunal date, which is in July! Alot of things have changed since the assessment, I also have major surgery planned for july. But I'm so worried that my life now doesn't really reflect what it was when I filled the form in.
I'm still not able to work, but doing everything in my power to try & get "back to normal".
I'm worried that the panel won't believe me. What was you experience of the tribunal?0 -

I have had a few IB tribunals.
Apart from the most recent, I always found them easy going (not before the event, I was stressed out over it) during the tribunal, and fair.
The last one was different though, felt like I was being *really* grilled, it went more like a ATOS medical assessment than a normal tribunal. I was not represented, and could hardly think at all....
But the previous ones were so different, very friendly, put me at ease, fair questioning, listened, no pressure etc.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
[/greenhighlight][redtitle]
The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that[/redtitle](house of lords debate, talking about Cameron)0 -

I had my IB tribunal 2 weeks ago and they kept stating that I was to think about my condition at the time of my ATOS interview and not how I was right now. I won't go into the rest of my tribunal as I don't want to scare people as I know how terrifying it is, and I have been told by the CAB guy that helped me that they're usually easier.
Try to get yourself someone from the CAB or a welfare officer as they are a great help. Go through your report and mark the things you disagree with, and if your mind goes blank when you're anxious like me then write notes as to why you disagree. Take these in with you to help.0 -

Ho o wise one, I wonder if you could tell me what the minority have problems with at the hearing.
Thanks just in anticipation that I don't fall into that trap!0
