The tenant should notify the benefits people that she has a BF who occasionally stays over and confirm with them that as he doesn't live there it should not effect benefits. Just so that the nosy neighbour doesn't cause her problems in the future.
The landlord really should be able to see that this dangerous path is all going to end in tears.
Morally its obvious to me that he is taking advantage of his position.
those who decide who get lha could look at this as being that the op is not staying there in order to get money from the lha and by not declaring this it would be fraud .
so he should inform the lha of their relationship

It's not simply whether you are breaking the law, it's whether you could appear to be breaking the law. For someone to claim housing benefit for renting a property from their boyfriend is pretty dodgy. If someone (?ex-boyfriend, ?neighbour) decides to report you the council may investigate to see if you were dating beforehand and/ or if you are actually living in the house.
Also if this relationship ends badly your tenant could claim you had insisted on personal favours in leiu of rent, or that she agreed to date you as she was worried about her child being made homeless. :eek: This behaviour from a landlord is very unprofessional and puts you both at risk of getting into trouble. If you write and advise the council that you have recently started dating but that you are not living together, you are protecting yourself for the future.

Edited to add: I have just remembered that tenants are entitled to quiet enjoyment of a rented property and that landlord's are only supposed to visit with prior agreement and 24 hours notice. It sounds like the tenant is getting a lot of enjoyment from this property at the movement, not necessarily quiet!
But the OP does need to take precautions about the worse case, and I could see a lot of problems if the relationship deteriorated, he wanted her out and she was well versed in the law and her rights. He could be taken for a different sort of ride. So he needs to get everything in order, inform the necessary people and protect his investment..
Good luck OP. I truly wish you well with this, but don't let love put you off doing what is right. There are countless stories on here of things turning sour, and the consequences are not only painful emotionally, but financially as well. I would suggest you get her to move out once the AST is ended and see how it goes from there.
