My Sexy Tenant

Could some one please tell me what my legal situation is here.

I bought a house 4 months ago for £50,000

£21.000 my money and £29.000 my mam and dads money.

The house is in my name and I take care of any bills ect. I pay my mam and dad back £100 a week.

The tenant gets the house, front garden, side garden, and access only to the back of the house from the back garden as I store to cars in the garden.

Any way back to the legal bit I have started dateing my tenant and stoping over at the house i rent to her. I am sure this would not normaly be a problem but she does not work at the minute and has a child. This means the DSS pay me £102.40p rent a week and she pays £7.60p a week to me.

What would the legal situation be if keep stoping over and we keep seeing each other. Is it not a problem or something I need to let the DSSknow about?

    seriously though, DSS etc needs to be informed- surely not going to charge your girlfriend rent (and claim for it??)
    Long time away from MSE, been dealing real life stuff..
    Sometimes seen lurking on the compers forum :-)

    Never mix business with pleasure. If your "sexy tenant" becomes less appealing in the future, you could be in a difficult position trying to get her out of your house after living there with her, aside from the DSS issue.

    I hope it works out well for you by the way, but this sounds like a potential nightmare situation to me, and I would suggest you read up on all the rules and regulations about living with tenants, get the necessary paperwork signed and protect not only your investment, but your parents as well.

    you cannot rent a house to your girlfriend and claim money of the lha for it that would be morrally wrong ..

    if not ever so slightly likely fraud ..

    i suggest you decide is she your gf or your tennant

    Agree with Genie - never mix business with pleasure - and especially if it's the tax payer picking up the tab.

    Not sure if this is a genuine post but yes William the LHA office should be told. Your T or you should probably do it before a neighbour does. Presumably you don't set your travel expenses down on your tax return................

    Get a different girlfriend or if your that desperate go to a massage !!!!!! , it'll be cheaper than having the authorities chasing you later , and no arguments with the Mrs :D

    OK, I think this is a wind-up.... but just for fun let's pretend it's not....

    This doesn't make sense. The DSS don't pay anything, as it no longer exists. Rent on private tenancies is supported by LHA - and unlike the old housing benefit, LHA will not make payments directly to a landlord, apart from certain exceptional circumstances, which don't appear to apply here. So presumably you meant to say that she pays you £110 a week rent, but because the LHA she receives is £7.60 a week short of the rent you are charging her, she has to make the shortfall up herself from her income support.......... and despite the fact that she is paying you you to let you live in her/your house, you are still taking this £7.60 top-up off her????????

    In any case, once tax has been deducted from the rent you are already out of pocket, and that's before you pay for the essential costs of being a landlord - you DO know about your legal obligations, and especially the forthcoming landlord registration scheme?

    So you keep your cars in her/your back garden, and live in her/your house, at least some days? LHA has specific provisions about renting a house from a relative (this includes a partner even if they are not married) so yes, you would have to declare the situation to the LHA. Think about it - is LHA really going to pay your girlfriend so she can give you money to live in a house that you own outright with no mortgage?
