Like most people in this world, artists like to be paid for their work.

Your friend is playing music in a public place and is required by law to have a licence.

The normal TV licence is not a licence for public performances.

The PRS organizes the collection of royalties.

It is not a rip off, it is not a scam. It is a fair method of rewarding artists for their work.

OMG!! Here I go again! Can we ask a Mod to merge the two threads?

Your assumption that it is required by Law is False as no precedent has ever been set! The PRS are using the Copyright, Design and Patent Act and seem to be relying on Section 72 not being relevant and others say it is relevant aslo sections 25,26 & 27 may be relevant and a number of other Acts that have some bearing, but no court has ruled that this is the case for any of them.

The PRS know that your average person can not afford to take this to the High Court, as this is where it would be heard, and so they continue demand their "Fees". Even some large Companies (Kwik Fit) prefer to pay the Licence than the potential 7 figure legal costs involved in getting a decision. This is why it is wrong and Very, Very wrong!!!

They've been hassling my wife in work - consisting of two employees in a broom cupboard office with no visiting public - demanding to know if they ever listen to the radio in work!

Just to let everyone know the British Chambers of Commerce are working on this issue at the moment.
As a new user I can't post the link, but if you go to Google and search for 'british chambers commerce prs' it's the first result.

Here's how one business sorted it out

They put up a sign that said

The music being played in this establishment is solely for the use of the individuals who work here.
The public are banned from listening to the music, as if they did listen the bullying, thieving scum at PRS would want money.
So if you are a member of the public, you must NOT listen to the music.

    Job done

The other thing to do [if you actaully believe you may need a licence] is ask for them to send out details and a contract in the post before you sign anything...they will refuse to do so.

You've offered to pay [pending contract details etc], and they've refused. Case over.

Otherwise if the PRS are correct, then EVERYONE will not only need a TV licence but a licence from the PRS as well.

If everyone made their front lounge open to the public, then yes that may be true.

Personally, my front lounge is open by invitation only ;)

You don't need a precendent in law if to prove a statute exists, the precedent is merely an interpretation of how a statute is applied.

The law exists - no one has successfully argued in a court of law that it doesn't exist. Therefore, there is no precedent to support your argument.

We had this mob call to our works, because we had a radio. (I don't remember seeing anything on the radio itself donating playing it to more than one person at a time), we simply turned it off...........then turned it back on again.

There is a Nightclub opposite us, that pumps music into the wee hours, awful music and deafening, surely its now my RIGHT not to have to listen to it, whether or not they have a licence to play that drivel.

They can word it anyway they wish, everyone knows its just another way to screw money out of the general public (royalty fees, My backside), for the past 50 years there's been no such thing as a PRS, up until the intervention of digitally illegal copies of music (which DOES affect the music artists). But as they seem incapable of getting the royalties from the pirates, they go for the easiest target they can find, someone with a transistor radio in a garage, listening to Radio1 (who have a licence to play to public and not an individual member of the public per individual radio).

Assuming I was mug enough to pay for such a licence, does this mean I could crank my radio into a 1000watt amp and legally blast it out for all to hear, whether or not the public want to hear it, or does the rate of volume its played at now depend on what level of licence I apply for?
