My colleague ordered a pair of Sofas from Tesco as shown here

They took payment, then called him at 21:30 last night and said they had refunded him as there was a stock issue. He maintains he wants the sofas.
As can be seen on the link, you *can* still order them at full price so it's clearly not a stock issue.
My understanding is that, as they charged him, that constitutes a contract and they are obliged to deliver.
Can anyone advise?0 -

You would be better posting onto the consumer rights thread but in answer to your question most companies inc Tesco only class a contract formed when the item has been despatched not when it has been ordered and paid for.
They are within their rights to refund legally due to these t&c's morally however .........0 -
Apparently it's a stock issue - and the website is lying

So anyone who ordered at the full price should also get a call relating to stock unavailability.
The caller **guaranteed** my colleague that if he orders them, they may take the money, but it will be refunded. The cynic in me wonders if an account flag on his name in their system would guarantee that.
No clear explanation as to why the price has gone back up.0 -
Box of 3 cream or caramel eggs, large sign said £1, Charged £1.50 I'd bought 3 so got dtd of £3. This was on an end of aisle promo box thingy by the till's, not the usual shelf.Booo!!!0

boughts REDS dvd was on the chart poster at £10 the charged me £13.97 got the dtd so it only cost me £6!0

I think the way it was phrased was perhaps wrong, but the posters comment is no different to your attitude, you went back to check on the money you handed in, why do that unless you were hoping it would be given back to you? You too could have just left it for a charity to have.
Please don't take that the wrong way either, because I would have gone back to check as well, it was just an observation to point out that you can't judge someone on a comment like that when they have already shown they are honest by handing the money in.0 -
Well, it seems that I owe Tesco an apology. The 28 days are up today and despite what I was told I have just been back in and they have given me the £40. I will give the money to my daughter's football team. Not a charity but still a worthy cause!0
