I'm generally miffed today for other litigation but this morning I got a letter from the Employment Tribunal Service saying that the second defendant in my claim has written to them saying that they transferred my contract of employment to the company that owes me wages, which busts their "i'm self employed" defence out of the window. FINALLY it seems we can now go to court and get this all sorted.

Glad youre getting things sorted out Amos, though I'm a bit witless and dont understand these things. Does that mean that because my OH is self-employed that we wont stand a chance of winning back our bank charges from Barclays if we have to go to court? Its only £535 but I was kinda counting on gettting it back. My good news is that today SWALEC credited our account with the money they owed us £480 as we have been overpaying them by dd. However, this small amount was immediately swallowed up by a massive black hole (the other name for it is our overdraft). The other good news is that my OH made friends with our mortgage adviser from Nationwide, to cut a long story short, and he went round to her flat and repaired her shower for her. She had got out £150 to pay him and tried to press it on him but as is his way it was 'No, dont worry, i dont want anything. Oh all right if you insist, I'll just take £20 for the parts. I felt slightly put out by this as he wants a new drill. Luckily she came into the school where I work today and left an envelope in reception and when I opened it I found £100 in cash in there so im a lot happier.

WHat you mean instead of "Its only £535 but I was kinda counting on gettting it back. However, this small amount was immediately swallowed up by a massive black hole (the other name for it is our overdraft). " Is, Ive paid off £480 of my overdraft debt with this refund!! Have you got onto your bank and asked for the OD to be reduced by this amount?!!? This is half of a thousand pounds, give or take and is a HUGE amount of money!! :T:

I think Amosworks has two "litigations" in process, one from his old employer, one about the bank charges. I think they are seperate. From what Ive seen on https://www.consumeractiongroup.com/forum being self employed is CERTAINTLY no barrier to claiming the bank charges back ,they are unfair- AND THATS THAT!! Happy claiming!

    Hi teshuoha,
That's great news with the electric and brown envelope job :) Congrats, you should definitely try and reduce your overdraft as theoretically that money didn't come out your budget so you won't need to dip in to it :T :T :T

As lynzpower correctly said, I am pursuing litigation against my former employers and my bank but they are separate. You can still get your money back even if your husband is self employed. The money my employers own is a more drawn out process, but I just happened to hear about both cases on the same day.

I'm just getting a bit nervous because its Barclays, and they're not replying to any of my letters. Will have to put in a claim next Saturday as the 14 days are up. No one seems to be having much success with Barclays at least I havent heard any. Nice to hear from you Lynz & Amos. Havent been on much this week what with work and being very busy with ebay. Have got up to £175 now in sales, though one negative feedback on a game my son said worked! I did come on here in one doss lesson in the computer room and read all the posts. Liked your story about the old lady, Amos. Thank you both youve always got good advice for me.
