I have also contacted Consumer Direct, but they weren't that interested when I said I had, eventually got a refund, but they seemed a bit unsure when I quote Unfair Terms at them, they were talking Breach of Contract and didn't seem to know much about these regulations, even though these can make the contract unenforceable and put the consumer back in the driving seat.
For a fuller explanation try Googling 'oft' (Office of Fair Trading) and 'unfair terms' (I can't put the link in due to restrictions!
I have also emailed bbc Watchdog - no reply as yet, but I know they are always ready to highlight shady practices with low-cost airlines.0 -
Thanks for that. I hope you don't mind but we copied and pasted onto our letter sent by registered delivery letter today. Let's hope I get some luck. Ironically my husband had a round robbin email off BMI Baby today showing European routes including - yes you guessed it - Almeria!!!
He said he nearly punched his monitor - but I can't believe they have just transferred it all to East Midland without even offering us who booked those flights first refusal.....now having to pay over £800 to fly from Brimingham - so East Midlands not that far away in driving terms! We're just gutted!! Why do things like this always happen when times are tight!!:( I'm now raiding my wardrobe to look for things to sell on ebay to raise funds - not good.0 -
Thanks for the info Stillstoneybroke, I have received 1 of 3 refunds but minus credit card fees so I will wait a while and then join battle using your excellent arguments. I believe these card charges are well out of hand but I don't have any idea of what the banks do charge, will have to investigate0

Air transport Users Council says if your flight is cancelled more than 14 days before departure:
Under EU law you are entitled to
A refund of the full price you paid for your ticket within seven days for the part or parts of your journey not made (and for the part or parts already made if the flight is no longer serving any purpose in relation to your original travel plan) and a return flight to the departure airport as soon as possible.

Re-routing to your final destination as soon as possible or, if you agree, at a later date. (If the airline flies you to another airport in your destination city then they must pay for the transfer to the airport you were booked for or to another close-by point of your choice)0 -

Just for info, I have received refunds for all flights minus credit charges so I will send another letter asking for a refund of these.0

Once an airline gets a bit of a reputation for doing this, can happen quickly with this internet lark, it really can be a problem and affects advanced bookings.GB Airways got a reputation for flight changes and cancellations and then got taken over by easyJet.
Strictly speaking easyJet took over GB because British Airways had decided to wash its hands of its UK franchise operations and GB wasn't well enough known to stand successfully on its own, but your point is no less valid for it - several other airlines have indeed suffered this fate.
To those who are still fighting over this, keep going! There's absolutely no way a company should be allowed to keep the money when it was their decision to withdraw the service in the first place. Do let us know how you get on.0 -

I paid with debit card so got £20 due back to me...still waiting for any sort of refund.
How did you get the refund? cheque or straight back into your bank account?0 -
My refund was credited back to same card I paid with on the same day I got the letter about the 'Gesture of Goodwill'.0
