    You won't mate, not from Crappy1 - have the FOS/ICO confirmed your complaint has been received? If not ring them and check, you should have heard something from them by now mate?

    Otherwise, how is the peace and quiet - at not hearing anything lol? :D

    Today I got an email from Call Credit:
    Hi XXXXXXX

    I am emailing with regards to the Capital One account currently under investigation.

    They have advised that will provide you with a copy of the default notice that was issued to you. Unfortunately, we are not permitted to make any amendments to the account. If you wish to dispute this further, I would advise for you to contact Capital One directly, once you have received the copy of the default notice.

    I trust this information is of assistance.

    Is the default gone from the other 2 CRA's or is it still showing? Regards to Call Credit, respond to email with the following: :D
    'This account is in severe dispute and has also been reported to the FOS & ICO for investigation due to the underhand and unlawful tactics used by the Original Creditor, Capital One. My argument with them is the fact they never followed procedure at the time of default issuance; subsequently the default is unlawful in its entirety.

    The fact you continue to post libellous data about me leaves you wide open to litigation, I therefore suggest you follow the example set by the main CRA's (Experian & Equifax) and remove the libellous data until such time the relevant governing bodies have assessed the complaint.

    The default was unlawful, continuing to advertise it on my credit file will result in legal action for Libel being taken against Call Credit'.

    It makes me wonder! These CRA always trust what the company says ie Capital One. So the customer Ie me, I dispute a entry on my file, Capital one says its correct and Call Credit say end of! Very Fair eh

    LOL, thats right - it is so annoying, the point is that you're not disputing that they defaulted you - you're disputing the way they done it which renders it invalid and unlawful.

    Course crappy1 will say they will send it, but that is not the point! My reply should make them see sense though! You know this will end up staying on your file, if I were you i;d seriously be applying for anything credit related asap whilst the defaults are off - you will struggle in the new year lol......

    Just giving you advance warning mate! This is the stage most people love, having a clear credit file - even for a month lol..... :D

    Is it doing your head in yet or have you learned to live with it now? At least its less stressful, right? Its more 'funny' now at their constant balls-ups! :rotfl:

    Your comments are noted. I can confirm that we are yet to receive a complaint from the FOS or the ICO with regards to this matter. We have followed our usual data disputes procedure and investigated this matter on your behalf with Capital One. Unfortunately they have not permitted us to make any amendment to the account, this includes removing the account from your credit report.

    You may wish to add a Notice of Correction to the account to explain why you are disputing the data. This is a 200-word statement that you can add to your credit file, to explain any entry on it. If you add a Notice of Correction to your credit file any organisation accessing your credit file through Callcredit will have access to your Notice of Correction. Please bear in mind that if you add a Notice of Correction to your credit file, lenders searching our database for information we hold about you are obliged under the Guide to Credit Scoring to read your Notice of Correction. This may slow down their decision of whether to offer you the product/service you have applied for. A Notice of Correction cannot be more than 200 words long. Any statement we believe to be defamatory, libellous, incorrect or frivolous may be referred to the Information Commissioner's Office for arbitration.

    I have attached to this email information regarding your Statutory Rights for your information.

    Hi matey - as you're not applying for credit a NOC will be fruitless at this stage, however their reply is bog-standard, without the complaint they can't do much so bear with it.

    We originally told the CRA's so they would remove it pending the outcome of your ICO/FOS complaints, usually the main 2 (Eq & Ex) remove the entry pending outcome, evidently CallCredit don't lol.

    Just hold fire and await communication from the governing bodies mate. Its a pain I know, but be patient. It'll get sorted within the next few months at least. :D

    I guess it's only a year in May until it is off as it will be 6 years old :)

    So either way not long now, as I dont hold much hope with the governing bodies

    I know what you mean mate but it is the principle, plus we want to get you some money back - as per their original promise (subsequently welched - huh!).....

    Its a pain but at least they know you're not giving up - plus we all know right now lenders are acting strange pending the test cases, but to be fair this will do little for them as we will win hands down. 1 down 6 to go! :D:D
