    You have an active complaint with them anyway - we knew it would go this far and they will send you a cheque! lol - idiots!

  • Hi, i have recently finished a trust deed and in a bid to repair my credit rating i firstly joined equifax then i wrote to the six companies which showed as default on my credit record with copies of my discharge and asked for the information to be updated. All but two, Cahoot and Egg have amended my record, cahoot actually sent me a default notice dated two years ago for the debt that was included and protected in the trust deed. So far equifax and the company that dealt with my trust deed have also written to Egg and Cahoot asking for my record to be amended they also sent copies of my discharge but to no avail. Do these companies have a legal obligation to update this information? Is there anything else i can do? Lawyers letters ect?

    I would write to Egg & Cahoot explaining that they are to ensure the default date is on or prior to the date of the trust deed and marked as satisfied.

    Enclose proof of settlement of the trust deed, and advise they have 28 days to comply with your lawful request to have non bona fide information corrected as per the data protection act.

    Advise failure to resolve the situation within this time frame may result in your taking action through the Information Commissioners Office and / or commencing legal proceedings for breach of Data Protection and Defamation of Character.

    If the account defaulted before the trust deed then the default can remain. They can still default you even though you do a TD/IVA - you know this right? Its not classified as 'pursuing a debt', moreso reporting the actual account conduct.

    The only exception would be if you paid up in full or whatever and then they added the default after you paid up. Then you can fight for removal. :mad:

    It is pointless arguing for default removal unless the OP can be a lot more specific..... :D
