    Goodluck marcellep, I'm sure they'll HAVE to get in contact sooner or later..

    On the subject of Cap1, just got a letter from them. Saying they can't process my appeal as i didn't sign the letter in person and only digitally signed. :confused:

    Signed it with a fancy cover letter, which was also signed.. now to play the waiting game. (Again)

    You never sign anything - you do not have to! If they insist it is usually because they want to copy it and cut/paste onto documents! Just say no.

    You're applying for credit aren'tt you? i.e. appealing a decline? If so, don't worry about my last post - thought you wanted a CCA..... well you do, but a new customer one lol.

    Signing is fine in this instance. :beer:

    I'd say it looks good, they will probably approve you now. Was this Cap1?

    Thing is, if they were going to say no they'd have wrote saying no - not asking for you to sign! Maybe the signature will be the overriding factor, i.e. he is real lets give him a chance! Who knows mate :confused:

    Was thinking along the same lines as you, oooor perhaps they're being REALLY evil by making me spend more money on stamps..

    Well I have had a reply from Capital One and as per usual it’s complete nonsense

    As I do not have a scanner, I have retyped the letter word for word, I have removed any account numbers and my own name from the letter.



    Thank you for writing to me about refunding the default sums we’ve added to your account.

    I can see from our records that you entered into a individual voluntary arrangement (“IVA”) with your creditors on May 2005.
    This date is when the applied the default NOT when I joined my Trust Deed!

    As part of the IVA you agreed the level of the outstanding debt with Capital One and on that basis Capital One agreed to accept a lower sum per £ in settlement of your debt. The outstanding balance that was agreed by you included the default sums added to your account. I am however able to consider changes before the IVA was agreed.

    We add late or failure to pay default sums if your payment is missed, arrives late or isn’t enough to cover your minimum payment. We’ll also add over limit default sums if your balance goes over your agreed credit limit, which is £200.

    When we opened your account in October 2002, we sent you a credit agreement which stated these default sums. By signing and returning this to us, you agreed to the terms and conditions for the account, including default sums.

    The office of fair trading (OFT) hasn’t challenged the right of the banks to charge default sums, just the level of those default sums. Capital one reduced the level of the default sums from September 2006 to £12 each, following the publication of the oft recommendation. However, I appreciate that you’ve incurred previous default sums at the higher rate, and would like to address this.

    I’ve reviewed the account and, as a matter of goodwill, I’d like to reduce the default sums we’ve added to £12 each. This amount totals £96. If you’d like to accept this offer, please sign and return the settlement form I’ve included. Once I get it back I’ll add these refunds to your account.
    Why should I accept £96? and how can they put it to my account when I do not have a card with them now. The account was included in my TD and I am now discharged. So does that not mean the account is cleared? Oh and no settlement form enclosed

    I hope I’ve explained things clearly, but if you do have any other questions, please write to me again. You’ll find my address in the leaflet I’ve included, which also explains our complaints procedure. If I don’t hear from you or your client within four weeks I’ll consider that you are happy with the response and that your complaint is closed.
    Least he is allowing me to write back to him!

    Yeah I am now prepared to go all the way! I think I have enough evidence that will make the case go in my favor!
