It has to be based on the balance of probabilities. I would suggest if they have 2 seperate thefts and you are the in common factor then on the probabilities a dismissal would be perfectly legal. Im not making a joke out of anything and resent that statement. I highlighted a point. Ive been in this horrible situation for 10 weeks now and dont find it amusing in the slightest. Stressful would be at the top of the list.
The post was delivered at 9am. I entered the property at 11am. The lady came home from work that afternoon. Thats a pretty big time line.
As also stated, im querying the dates in relation to the allegation of when the money went missing as a few bits do not add up that ive read in the notes.0 -
Granted but if its deemed Miss A or whoever else is saying only you and the butcher had access are competent to state that then what you think is irrelevant.
Tbh the police have put a lot of efforrt into this investigation and you as a suspect so there is clearly something they feel to answer.0 -
I also think if it comes down to what you have posted.
2 seperate thefts from clients. Yourself the common factor in both, only one other person posssible responsible then the balance of probabilities will see diismissal justified.0 -
Of course the other common factor is Miss A and above OP says that Mrs B said there had been a problem with items missing 3 years ago..0

Miss A had the items stolen from her property though, unless the police find its her doing it for attention or whatever then I still reckon a dismissal would stand up.0

Ive read these posts with horror over the last few weeks. I really feel for the OP and have to say I am shocked and dismayed at the responses of one particular poster, who appears to have the OP marked as an out an out villain. I thought the idea of our forums were to offer support and advice, not to attack.0

The allegation is money missing from a clients house and an item of post missing from another clients neighbour.
The extracts from the notes with Miss A and Mrs B refer to the client and her neighbour - The allegation of the bra going missing from the package.
So because I went through the communal hallway during x amount of hours that the bra was taken from the package and in relation to the other allegation because I was one of the carers that went to the property during the period of days the money went missing you believe they will be justified in dismissing me.0 -

Yes I think on the balance of probabilities that on 2 seperate occasions you have been one of the few people available to steal the items yes dismissal is acceptable
Unless the butcher was present last time or the client gets found out as a liar we have that you have been the only common factor at two thefts and on the balance of probabilities I think dismissal would be justifiable.0 -

I have read this thread, from the beginning with interest.
I am a qualified HR Professional and I have to say that your employer's (as you already know!) have not followed Employment Law correctly in their procedures. The fact that they retained Croners' services at such a late stage proves this.
As some users have already stated that the criminal investigation by the Police and the civil investigation by your Employers are separate and as such will have different outcomes.
If the police do not find enough evidence to secure a conviction, the Crown Prosecution Service will "throw it out of Court". This however does not mean that you are found to be "not guilty". I must stress that I am not saying you are guilty or not guilty BUT merely playing Devil's Advocate.
A Judge or Jury would need to find you "guilty without doubt" for you to have a criminal record.
The criminal investigation is besides the point. However, you will need to know how the Police have arrived at the opinion that it could be you. Just because you passed through a communal hallway or that you were one of a number of carers looking after the Client. Did she not have any other visitors between Thursday PM and Friday PM? You mentioned that there was another Carer on a Thursday PM. What time did they arrive at? What time did you leave at? All these questions need to be addressed....
