  • I'm not a lawyer but, if you want to keep a record of phone conversations, it's legal to record your own calls - isn't it?

    I think you have to inform the other party you are recording the conversation

    Is it really wise to write a reply before you receive the letter advising you of the meeting? And is it wise to tell them up front that they are breaching the rules by not allowing enough time?

    I just wonder if you should allow them enough rope to hang themselves, as it were??? Don't tell them they are doing it wrong - let them go ahead and breach the rules and then you have even more ammunition when you go to tribunal. Just a thought - would appreciate the comments of those people who know more about these procedures.

    Thank you to everyone for your replies, its really appreciated.

    I sent the email yesterday afternoon. This morning I received a call from the MD saying that due to our last conversation, he is now willing to hold the meeting at my local office, however he would have to postpone it until 1345hrs tomorrow. I advised him that as yet I had still not received any letter, but the postman was due to arrive within the next 30 minutes and that id rather wait until i'd had time to review the letter before attending the meeting. He asked me to call him back and tell him whether the letter arrived today.

    Anyway, the postman arrived and I received a letter dated the 2nd June saying
    "I am taking into account of the telephone conversation we had today. You have stated that you are unable to attend the meeting at head office on Thursday, you have stated that it is too far for you to travel as it is a 120 mile return journey. I am therefore postponing the meeting for a further date, I'll write to you of the time and date, I'll try to hold it at your local office for your convenience.

    Should you have any concern don't hesitate to contact me"

    I phoned him back and advised I had only received this letter and not the one regarding the disciplinary meeting. He said he found this very strange but would "personally" post it. He said he would also arrange the meeting for a date next week. I advised him any day apart from Tuesday as thats the date im re-attending the police station and he said "Thats the day ive already booked it for, but it looks like i'll have to change it"

    I then gave the PC a call who was investigating the matter as originally he said it would be dealt with a lot sooner then the 8 weeks I was bailed for. I just wanted an update as to whether the investigation would be finialsied by Tuesday or whether I would be re-bailed.
    He stated that he would have to rebail me as he has finished his part of the investagation and has been waiting for my company to finsih their part"

    Im going to try and pop down the police station today to get rebailed, just so im aware of the new date. I dont know what part my work are playing in the police investigation, or even if they know the result of the investigation is awaiting them finishing whatever they need to do. Personally I dont think they do otherwise the MD would have acted pretty fast so he wouldnt have to keep paying me suspension pay.

    Looks like more waiting now!

    Another quick update!

    Just got back from the police station, ive been re-bailed until the 8th July. The PC said that he has finished his investigation and is just awaiting a report from social services before he can finish typing his report up. He said he got it mixed up and its not my company he waiting to hear back from, but social services.

    Were due to go on holiday on the 13th July - Our first family holiday! So he said he's going to try and get this all finished by then as "you probably dont want to go away with this on your mind"

    Im not sure how the MD will take it when he finds out ive been re-bailed and as such suspended on full pay for another month.

    If he wants to set your mind at rest, it sounds very much like there won't be charges, which is good news.

    By the way, have you considered making a complaint against the PC, given that he arrested you despite your voluntary attendence? You've got a mark against your record just because he has a target of arrests per month? Might get you off the DNA database as well.

    Thank you all for your replies.

    I dont work for social services so i presume the report is more then likely to be regarding the complainant. I cant think what else it could be about.

    I received a letter from work today advising me of a disciplinary meeting this Friday. It outlines what its concerning a long with copies of notes etc.

    One part of the letter I did find a bit worrying was
    You are advised that if the allegations are believed to be proven, it will be considered Gross Misconduct under the company disciplinary rules and your employment may be summarily terminated.

    Thats my bold in the above quote, but just curious as to whether thats all a comapny needs to dismiss someone. I could understand if it said "if proven", but believed to be proven I find confusing - especially when the police are still investigation.

    That’s bizarre isn’t it? Surely something is either proven or not.

    From some of the other things that you’ve stated the employer has done I would not be too concerned about it (as far as that is possible ;)).
