The only advice I should have taken sooner was to place you on ignore. Job done.

    Yes quite right

Clearly the avon rep claiming to be an HR professional whilst giving completely false advice is the best person to listen too

At least you will have soft skin for your court case and interviews at the job centre:rotfl:

Picked up a few more bits of information from work today along with the company grievance and disciplinary procedures for staff.

Ive been given some notes in relation to this statement
A couple of weeks ago £150 given and was gone in no time. Same carer in at around that time!
"On the ladies original complaint record it states at the end of the report that a couple of weeks before the alleged £100 went missing, £150 was given to the lady and was gone in no time. This is not in relation to the alleged incident or sexyeyes83"
Another set of notes from when the PC originally attended state
PC advised that he would be writing up a report regarding this incident and that there were 3 or 4 people who had opportunity to take the money but it cant be pin-pointed to one person. PC advised at this present time there will be no further action. PC advised that he would send us a copy of his report.
I asked work for a copy of this report and they said they had never received a copy and hadnt bothered to chase it up with the PC.

In relation to the company Disciplinary procedure it states
The individual has the right to be accompanied by a friend or witness
I phoned the MD to advise I was going to be bringing a friend along to take notes in the meeting. He asked who she was and what her profession was. He thn said he would get back to me.
10 minutes later he phoned back saying he did not want me bringing any friends along and in this instance he was willing to waive the ban regarding me talking to work colleagues about the matter so one of them can attend.

Ive since put this into a grievance and emailed him a copy and sent him a copy via 1st class recorded delivery.
  • What exactly did your grievance say?
  • Hi sexyeyes. I can't offer any advice but I just wanted to wish you good luck. Hopefully this horrible situation will be sorted out soon. xxx

Reading through this whole thread has made my blood boil regarding the level and degree of this employer's bullying and harrassment!:mad::mad::mad:

But it was your last post sexyeyes that particularly got my goat in relation to the behaviour of this MD of yours!

    What a bloody cheek?!
    1) The employer first directs you, the accused, not to make any contact with your colleagues regarding this matter.
    2) He is fully aware that most (if not all) of the carers in the company are not represented by a Union.

AND THEN - He has the audacity to tell you that HE will only allow a colleague or union representative to accompany you to the meeting?!! FCUK you matey!
It blaringly obvious to any outsider that this guy is a nasty, sad, spoilt bully, who simply wants it his own way with no regard for your welfare.

Stick to the terms of the company's disciplinary policy document, it's a legal document afterall. Don't let him try to out manoeuvre you with his searching questions or unreasonable pressurising decisions.

I was really hoping you hadn't played to this crass arrogant bully by telling him who your planned friend / witness was and her occupation ?????? As he had no right to know!!!!!! He could of course ask? But it was none of his damn business! and you were under no obligation to furnish him with the information!
What F'ing right does he have to know who you are bring with you until the day of the actual meeting when you arrive with them at your side, in line with company policy........ cheeky b@stard!
I'd have told him where to get off! But then that's experience talking, because I've been caught out in a similar fashion in my past when dealing with a bully for a boss.

My heart really goes out to you sexyeyes and I am praying that this nightmare will be over for you very soon. I'm sure you must be feeling very stressed indeed and are going to need that summer holiday of yours, more than most, by the time this is over.

Forget the company - Just make sure you look after yourself and you have the type of representation and witnesses you want, not who they would want you to have!

Sending You My Very Best Wishes :D Good Luck with this and in your future.
Be kinder than necessary, for everyone you meet is fighting some kind of battle. :A

    Hi,
Sorry about the delay, things have been a little hectic.

I attended the meeting on Friday which the MD did not sit in on. It was headed by an administrator from HQ who read through the notes the night before.
I went through everything again with them, and then asked my questions I had prepared. I had roughly 20 questions, however they wasnt able to answer any of them, except saying "We dont know, you would need to ask the police"

The meeting finished at 12 o'clock and they said they would be in touch with me. At 2pm I received a call saying she had made a decision and would let me know on Wednesday.

Yesterday I received a call asking me to go down to the office. I was only there for around 5 minutes. It was only the administrator from HQ and a local manager taking notes. The administrator said
"After reading over the notes and speaking to you on Friday, I find it very funny that you was in both places. I have looked into if there are any other positions within the company for you to work, however unfortunately there isnt at present.
This job involves looking after vulnerable people and we are unable to trust you, therefore we are terminating your contract. You will receive four weeks pay in lieu of notice"
Im now just waiting to receive the notes of Fridays meeting, along with the notes from yesterday and the resons for dismissal before looking at the next step.

Oh, sexyeyes, I am really really sorry for you. I'd feared this would happen when the MD pre-judged the outcome of the hearing and said you'd brought it all on yourself.

So, they don't trust you in this job, but were prepared to offer you another position in the company if one was available? How does that make sense?

This is a silly question, but some of your previous emails weren't clear. The person who apparently had the money stolen, had a previous sum taken when you could prove you weren't around? Or they were given a similar sum and spent it so quickly the carers were surprised ie. was the money definately stolen or does she have a habit of going though cash quite fast? I've had a few elderly relatives who when they got quite doddery made lots of accusations about stuff being stolen, when they'd just mislaid or spent it.

I've got nothing to offer except commiserations - and I think every poster who has contributed here (barring the resident troll who does this on lots of threads!) would feel the same. Do you know when the police will get back to you?

I hope you take good professional advice from an employment lawyer.

You next step should be to lodge an appeal against the decision.

I thought that as well Cathryn. Why even consider looking to place a member of staff into another position within the company if they have no trust in you. I was also quite shocked about the four weeks pay in lieu of notice they are giving me.

Regarding the person that had the money stolen - This took place in January and I was suspended. The police looked into the matter and came back with this reply in the notes of the meeting
PC advised that he would be writing up a report regarding this incident and that there were 3 or 4 people who had opportunity to take the money but it cant be pin-pointed to one person. PC advised at this present time there will be no further action. PC advised that he would send us a copy of his report.

However in the original report work took, it also stated
A couple of weeks ago £150 given and was gone in no time. Same carer in at around that time!

I chased this up with work to establish if there was 1 or 2 allegations and they advised there was only one. They said
"On the ladies original complaint record it states at the end of the report that a couple of weeks before the alleged £100 went missing, £150 was given to the lady and was gone in no time. This is not in relation to the alleged incident or sexyeyes83"

However, the police interviewed be regarding 2 allegations of theft from this womans house. The original one and also the one a few weeks previous which is where I entered the house during the four day period it went missing. I still find it confusing myself. Work say 1, police say 2 and they both state different amounts of money.
During the meeting on Friday, work stated that this lady always leaves her door open and "would invite anyone into her house, even a woman walking a dog she didnt know"

I know the next step is to appeal the decision, however makes me angry that I need to appeal to keep working for a place that have stated they have no trust in me. I will wait till I have received all the notes/decisions and then speak to an employment soliciator.
