Went down the hardship route in December £4200.00 claimed
After phone calls to chase and a couple of missed responses from them with deadlines promised, rec'd letter today with award of £5200.00 :beer: :T :j
Can now pay our bills
Have to say the Abbey have been very good whenever we've spoken to them (other than not keeping to timescales promised, meaning stress trying to keep creditors at bay ) but to have this sorted in around 6 weeks has been 1st class.0 -

Bank Charge Claim raised against Clydesdale Bank
First Small Claim Court Action April 2008
Sheriff did not allow sist on financial hardship grounds
Bank found it "uneconomic" to proceed to proof and settled.
I received £3,600 (charges + judicial rate interest) end of June 2008
Second Small Claim Court Action raised against Clydesdale Bank October 2008
Sheriff refused sist on grounds of financial hardship and set proof hearing for start of February 2009
Bank has now formally offered full settlement of £3,200 (charges + judicial rate interest) and informed court of accepted offer

I followed all the advice on this site. I am disabled and on benefits and debt management plan.
I found the Sheriff Clerk very helpful.
In Court the Sheriff and officials went out of their way to help and explain to all of us representing ourselves anything we did not understand

I have two current accounts with RBS and going back to 2004 found that when my account were up near their limit charges have gone on after midnight on a particular day and the following day it showed the account being over the limit and a £28 has been applied at the end of the month. I have almost always corrected the over limit figure the day I discovered it. It took me several years to figure out why this was happening. I am currently arguing that charges applied should show on Internet Banking the same day, preferably by close of business about say 5-00 pm.
What is more alarming is that the system gives out inaccurate information. I recently did a test to show this. My wife has a Yorkshire Bank account and I do the Internet Banking for her. Before going to the shops I got an Internet printout for each account. At the shops we each made two small purchases on our debit cards. Back at home my wife's account showed each amount that she had paid for her purchases.
Mine however simply showed a reduction in the amount available which was a total of the two purchases.
The alarming part is that when the first payment came through the amount available INCREASED by the amount of my other purchase when it should have stayed the same. The problem showed itself in a graphic way today. Last night I checked availability and it showed that £16.00 was available. This morning I was shocked to see that a penalty charge of £35.00 had been applied for 'Card Abuse'. When I telephoned my bank I was told that a Debit Card payment for under £7.00 had gone through and taken it over the limit. They are refunding this amount but not till Monday. This caused another payment to be declined and I have had to transfer money to cover it.
I put in a claim on my two accounts last October and pressed it through Financial Hardship and I have received an offer on the two accounts for £1,900.00. One of the accounts has built up because of penalty charges that have been added from October through to January. What is important is that they alter their Internet Banking so that it always gives accurate information and they stop sticking these £35.00 penalty charges on which always causes ongoing problems.
Their offer of a settlement in my eyes is an admission that these charges ARE ILLEGAL.

I put in a claim in August 2008 for £2777 and told them if they were willing to pay what they unfairly took from me, I was willing to accept minus the interest of £777.00. I had a letter this morning to say they were paying £2167, so looked at my account this morning and it's already in there! Happy days. Can now pay off all (well most!) of my bills : ¬)

cant remeber how much i tried to reclaim it was less then 1000 well over a year ago and told it was all on hold untill test case got a letter last week and got offered 722 and took it...well pleased i had completly fogot about it
