    Good luck on your case, Orange are in the wrong!! These mobile companies get away with murder. I dont know the law, so I dont know all the ins and outs. But you have my support!! :beer:

    You know what friend,:T I have thought exactly what you are saying and have grown tired of defending myself (O.K. Sometimes with as good as I get terse comments!) against some apparently mean spirited individuals who I wonder why they come here.:confused:

    So much so that I am not going to reply to anyone, nice comments or otherwise until I have heard further from the Court.
    Though I may just put a "Any other thoughts please" if no one has added anything for a while to help keep interest going and take it to the top of the pile for people who haven't spotted the post yet.

    I wish to thank all who have contributed good and bad and I will certainly take on board any constructive advice given.
    Of course I will regularly come here to see what, if anything is going on with this.
    In the meantime, please keep voting and I am naturally pleased to see that at the moment more people think that I am in the right suing Orange than not.:j

    Tis a shame that my post appears to have been removed because I disagreed with the poll. A problem with this site as it seems some that lurch on to compensation grabbers as Trolls because they disagree with their victim sympathy ethics

    Such a shame nowadays we have a society fed on a soap diet of fist led confrontation that does now allow a mediation to take place.
    I will still not vote in a poll that does not give mediation a choice and reiterate my previous comments, though toned down.

    I'm not surprised it was removed if you're making personal comments like that.

    I had the same thing with Tiscali, sadly I paid as I was pregnant (high risk pregnancy) and it wasn't worth the stress over £30
    If my typing is pants or I seem partcuarly blunt, please excuse me, it physically hurts to type. :wall: If I seem a bit random and don't make a lot of sense, it may have something to do with the voice recognition software that I'm using!

    Hello again all:D

    This morning (19th May 2009) I received the following letter from Orange. I quote from the relevent point...........................................................

    'In light of the above, and in the interests of saving time and costs involved for both parties in going to court, I am willing to offer the following in full and final settlement of your claim, on a strictly without admission of liability basis'

    1. The sum of £35 to cover your court fee; and

    2. A further sum of £100 as a gesture of goodwill

    Total: £135

    We believe that this offer is reasonable in the circumstances as Orange has apologised for its error, and has refunded the amount in dispute.

    My answer already sent off to Orange:-

    Orange

    Good Morning,
    Thank you for your letter received this morning dated 15th May 2009.

    Please note that I do not agree with Orange account of what happened in respect of it's original claim against me in the sum of £22.99 and totally reject the assumption that I owed any monies whatsoever to Orange.

    However, to draw a line under this, I am willing to accept your offer of £135 without predudice, in respect of full and final settlement in respect of my claim, and I also accept that this is strictly without admission of liability by Orange.

    In order to close the situation finally for both Orange and me I would appreciate if you can make payment at your earliest convenience to my Bank Account as follows:-

    So there you have it guys. I have come to the conclusion that it is probably just about wiser to accept this offer than pay a further £50 to take it to a Court Hearing.
    I have listened to everyone, even the wannabe solicitors:D and various snide remarks people:rolleyes:.

    I do hope that this post has given some people information which may help them, and even amusement to all.

    The only thing that has suprised me here is finding an amount of apparantly mean spirited people who seem to be on the side of the Companies who Dump on us rather than the people who have been Dumped on!:D

    Big deal. You could have achieved that without issuing proceedings.

    Managed to get £475 out of Tiscali for a relative for a very similar situation...no need to issue proceedings either.
