Neither you nor your mother lived in the property therefore even if you had declared that it wasn't your mothers second home then it would have been your second home either way the charge would be the same.
TBH we have numerous properties where we don't know who the owner is until we check with the land registry even then we just raise the account as necessary without any fuss.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
the house is in my name. my mum lived there til June 2006. No one live there til feb 2009. the council tax paid during that time was based on it being a second home. I have no previuos proper address.. i'm not sure where i stand. the house has always been registered in my mums name as the owner occupier for council tax even though I have the deeds.0

As afar as I can see there is no fraud. In fact they may have been paying more than was required if the house was empty.
Anyway, this would be mum's responsibility, not weeone's, until such time as weeone moved in.If you've have not made a mistake, you've made nothing0 -

It is almost certainly completely irrelevant.
The coucil does not care one hoot who owns a house, what they want to know is who lives there. Your mum said she did. Which we understand was correct. This is nothing to do with you.
If she claimed it was her second home rather than first home then in theory the council have an issue with mum, but may not pursue it given her health.
However, in the two years between my mother going into hospital and selling the house, we paid NO Council tax and you have been paying for three years?If you've have not made a mistake, you've made nothing0
