    People do it, its no secret but it is of course, morally wrong and could be illegal in some cases - especially if you have no intentions of repayment. Nor recommended.

    well that would be affected by the unenforceability issues, so wouldn't play too much of a factor to be honest..... :beer:

    i.e. your credit file will already be knacked but at least they cannot pursue you for the debt.
    If the CCA is invalid can they still share your data?

    So there must be not so honest people out there laughing literally all the way to the bank?

    Its so wrong, i work 80 hours a week sometimes to pay my way in life and i always try to be a morally upstanding person.

    Yes there are people who do this but risk prosecution by the lender as it would be easy to prove.

    When you cannot pay, usually the pattern of events would show a maxed out card with min payments every month for a few months prior to falling behind.....

    I agree it is wrong, but not everyone has our morals....

    Yes until you get them to remove it which is at their discretion.... basically the debt is unenforceable but the debt does remain - just means they do not pursue you for it.

    this means the adverse data can also stay, unless you know how to get it removed (template letter is on the thread page 1) :rotfl:

    In all seriousness those types of emails seem to have died out in favour of online bank phishing, but check here for ideas on how to deal with them - brilliant stuff ;)
