    Could you briefly run through the steps you followed, or perhaps post a scan of forms you had to send? (blanking out personal stuff obviously)

    I am also wondering is there a time limit to register initial complaint as there is only a few days until the hikes come into effect, and if so how best to do that, if anyone knows?

    I can only find Flext 40 and Combi35

    The steps I took were to inform T-mobile within 30 days of their notification that I wished to cancel. They then informed me about the termination fee.

    I escalated via many different depts until I got to the customer services directors office. Once here they informed me that their stance was final, I informed them that I would pursue the matter via the county court.

    Went to moneyclaim.gov.uk and filled out the form:

    Sat back and waited, let the 19 days run their course and then filed for judgement as they failed to defend or acknowledge the claim.

    Haven't needed to file for a warrant yet as T-mob have said they will be paying up! But they have another week to get the money to me before I do go for the warrant.

    Really quite simple and straight forward.

    I did have a bit of a back up plan on my claim, I was waiting for their defence of "08 numbers are not a service but an additional service" which is what I kept getting told via their customer services, but in their T&C's under section 1. Definitions, they clearly state that additional services are in fact Services!!!

    Hi All,

    Just to let you know, I have been following this thread since I have received my text for the changes and have filed my own claim against them for the same reason. (I am not happy)

    Thanks for all of your advice and help, smcaul - It is an easy process.

    I have contacted them numerous times by email as well as phone and have been denied on all occasions.

    I'll let you know how I get on.
  • I've done the same and taken them to court too.

    This isn't just about the money. There are very important principles at stake. T-mobile seems to think it can ignore consumer protection and contract law, assisted by impotent Ofcom and tame beasts like Cisas. It is astonishing that T-mobile can tear up consumer contracts and ignore the Unfair Terms provisions, yet Ofcom does nothing.

    I don't think the courts will stand for it, and I don't think T-mobile will risk losing a judgement.

    I received a very bolshy reply from T-mobile customer relations today. However, it will be interesting to see whether T-mobile remains as confident when it receives the court papers.

    Glad I'm not the only one to have done it. Hope you both get the same result I did. But to be honest I still think t-mob will just let it go to judgement by default so no precedent is set, even though being a County Court the precedent would mean nothing.

    I think they may get a handful of people like us, and it is far cheaper to just pay us off then it would be to admit they are in breach of contract.

    Oh, and still no cheque yet!!!
