  • all t-mobile customer services have been given the same thing about how the government or ofcom have forced them, yet on the site it says because people are confused. i know they have been given a script as both myself and a friend have tried with this and told the exact same thing, with one of them saying "let me quote what i have been told to say". They are just greedy and hope people see through it.

    well I think we should all e mail Tmob and ask to camcel as this is a major change as per T&Cs

    The whole point of a contract is that it protects both parties. If either one wants to change anything in the contract then the other party can leave the contract.

    T-mobile want to change the cost of the calls, so the customer has the right to walk away from the contract without penalty.

    If T-mobile dont want to loose those customers then they should not change the terms of the contracts. Simple.

    You have hit the nail right on the head.

    In all binding business contracts any changes by either side will leave the contract null and void, with compensation payable to the injured party. Such is in our contracts, the very small print is interpreted in the networks favour so they do as they want.

    One of the many 'oddites' that the Mobile Phone Industry as a whole is allowed to get away with. There are so many 'grey' areas that go on which would normally end up in court or ruled against by the Regulater :rotfl: , that are ignored by Ofcom, PhonePayPlus, the Networks and the Law of the land aka HM Government.

    Why, You may ask? Simple answer is that all these 'interested' parties have a financial interest to keep things as they are. We the Mobile Phone Users, aka 'The Mugs' continue to fund them and not one b****er cares or is willing to protect us.

    You are also correct, but our contracts are an agreement by two parties for a set period. Do you not agree that any changes to the terms of that agreement, no matter how small, is a breach of contract?

    Just thought I'd look up and put the relevant T&C section in this thread. So.....
    7.2.5. A cancellation charge won’t apply if You are within Your Minimum
    Term and:
    7.2.5.1. Our entitlement to operate the Network ends at any time; or
    7.2.5.2. You are a Consumer and the change that We gave You
    Written Notice of in point 2.11.2 or 7.1.4 above is of material detriment
    to You and You give Us notice to immediately cancel this Agreement
    before the change takes effect; or
    7.2.5.3. The change that We gave You Written Notice of in point 7.1.4
    is an increase in Your Price Plan Charge (as a percentage) higher than
    any increase in the Retail Price Index (also calculated as a percentage)
    for the 12 months before the month in which We send You Written Notice
    and You give Us notice to immediately cancel this Agreement before the
    change takes effect.


    7.2.5.3 is irrelevant as this increase is not a price plan charge (ie monthly line rental - this is established earlier in the T&Cs).

    7.2.5.2 mentions a material detriment, as i specified before.

    These T&Cs were what you should have read before you signed up for the contract, and were what you agreed to of your own free will. If you didn't like it, you should have got a pay as you go.

    So I guess people wont be allowed to cancel as no T+C's were broken?

    Well I emailed T-Mobile advising them of the OfCom's guidelines on 08x numbers which state that they should really be in line with standard call charges and should really be part of your monthy allowance.

    T-Mobile replied saying that "we don't have to follow these guidelines". Basically, they have admitted that they dont give a sht about their customers and will do anything to screw us over.

    It makes my blood boil as their T&Cs are completely one sided so therefore we dont have a leg to stand on. Totally unfair.

    It may be worth trying to cancel under the unfair contract regulations and then report them to Ofcom
