T-Mobile Contract Cancellation

Hello People of moneysaving world!
I had a 12 month contract with T-Mobile which should have ended in December. I recieved a phonecall from a comany named Sheraton Services (I think) offering me an 18 month contract with 3 and they said my contract with T-Mobile would be replaced by this.
I assumed (stupidly) that this meant they would cancel the contract on my behalf.
I received no correspondance whatsoever from T-Mobile to ask whether I wanted to cancel or renew my contract.
However, after checking through my bank statements I've noticed that T-Mobile have still been charging me.:eek:
It seems unfair that they have continued to charge after the agreed term of 12 months, especially since I haven't used any of the services they have been charging me for (line-rental, messages etc)
Does anyone know if there is anything I can do about this?
Or have I just been ridiculously neave? It's not beyond the realms of possibility.

You sign for a minimum term contract, it rolls over until you tell T-mobile whether you want to keep it, or cancel it, nobody else can cancel on your behalf either, so the other company were talking rubbish.~*Cerenia*~

The only possible hope for you is did you keep your number ?
Other than that you have been ripped off - by Sheraton Services - not T mobile in this case and I don't fancy your chances of getting it back.TANSTAAFL !0 -

I wonder without ending the contract, how could "3" port your number?

[FONT="]With regards the early cancellation with no penalty business. I spoke with customer relations at T-Mobile today. They had spoken with the legal department and basically they had an answer for everything. All the points I raised in the terms and conditions were covered. I can go into more details if people want me to but the chances of getting out of your contract with this are zero. I did manage to get £10 a month credit to cover the extra cost but as I’m in the last two months of my contract I can’t see this being the “norm”[/FONT]

[FONT="]The my argument was based on these points in the terms and conditions[/FONT]
[FONT="]I’ll go through what T-Mobile said point by point[/FONT]
[FONT="]7.1.4. We can increase any Price Plan Charge. We will give You Written[/FONT]
[FONT="]Notice one calendar month before We do so. The change will then apply[/FONT]
[FONT="]to You once that notice has run out.[/FONT]
[FONT="]This one is a none starter as the price plans haven’t changed[/FONT]
[FONT="]2.11.2. If You are a Consumer and the change is of material detriment[/FONT]
[FONT="]to You, We will send You Written Notice one calendar month before the[/FONT]
[FONT="]terms and conditions are due to change. The new terms and conditions[/FONT]
[FONT="]will apply to You once the calendar month’s notice has run out unless[/FONT]
[FONT="]You terminate Your Agreement with Us within that notice period. If[/FONT]
[FONT="]You do this You won’t have to pay any cancellation charge that would[/FONT]

[FONT="]I was told be the guy at customer relations that their legal department would “fight this all the way”.[/FONT]
[FONT="]This means big courts cost if you take it that far and lose.[/FONT]
[FONT="]I did manage to get £10 credit for May and I can terminate my contract in May but it’s up in June when I could have dropped to a lower tariff and paid up anyway.[/FONT]

Uh! It is part of their T&C's, it is callased as an additional service, and under section 1. of their T&C's it very clearly states that by definition an additional service is classed as a service.
As for being expensive to take to court, it is not expensive at all, far cheaper then having to see the contract out in my case.0 -
thats right but there is nothing in T&C's that covers cost changes to additional services. legally they can charge what they want for these.
i've been banging on at them for about this for three weeks. they have changed it now because they are adding 08 numbers to what is included in the flex contracts.0 -
But until a month ago there was no mention of 08 numbers being an additional service
and
08 numbers were charged differently on Combi and FlexT (ie they were part of the tarrif as shown by the price plan page
and
how can phoning my bank, hospital, GP, electricity boarad numerous government departments be an additional service?
and
if its not part of my contract then why do they expect me to pay for anything which I'm not contracted to do ?
We need as many people as possible to complain toi Offcom then perhaps they will take noticeTANSTAAFL !0
