What court can it go to though, the Civil Court ?

They provide 'invoices' non contractual ones, so how can these types of 'fines' get to County Court ?

One other point. As the "fines" (charges) imposed by PPCs relate to the breaking of a contract, posters who have "legal cover" with their buildings and contents insurance may find that this covers them in terms of legal advice and also costs in the case where they are taken to court. I have used my cover to obtain legal advice with regard to my "fine" and the solicitor who gave me the advice said that in all probability I was covered if the case went to a CCJ. As the cover is a separate part of the insurance, your household "no claims" benefit is not affected.

Why are you consulting a solicitor about an invoice from APCOA?
Better advice [IGNORE!] is available here for free.
If hell froze over and you ended up in court you wouldnt need insurance because you would win and the PPC would pay your costs.
All this is irrelevant anyway as APCOA have never taken anyone to court.

The county court IS a civil court. Thats where it goes if the PPC is stupid enough to try it on.

Regardless of the status of the invoices the parking company can issue a claim in the County Court for a breach of contract or less likely trespass.

What they can't do is issue a claim for you not paying their "fine" or "penalty" , private individuals and companies have no powers to fine or penalise another private individual and they know it !!

I don't believe they do sell it on ..after all you can't sell something that does not exist.:rotfl:

A lot still dont understand how these scams work.
    They need a bite !
There is never a shortage of folk wanting to be proved right and it is this weakness that these companies exploit, someone who is strong minded knows it is a scam and they know the best way to deal with any scam is to ignore them .

You can sell it on to someone who runs a Call Centre of monkeys who can't find proper jobs and who harasses the weak and naive until they buckle under, or until they know it's a lost cause when they have to give up !

A debt is for something you have asked for, rec'd it and not paid for so can be sold on.. If you park and have paid for then there is no debt. A ticket for , say, parking just over the lines is only a speculative invoice for something you have not asked for, not received and so therefore cannot be sold on as a debt as it does not exist.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

In that case, they delude themselves into calling said invoice a 'debt' in that case.

I agree, under 'normal' trading terms, this is not a 'debt', more a 'contrived figure' - a 'con' in other words.

Jeez, I bet 80% ( Pareto Law) pay this invoice due to nothing more than harassment and scare tactics.
