I would LOVE my day in Court with Graham White Solicitors! I know they'd lose hands down! I am not at the address I was at, at the time, and have asked the person living there to return any letters from them, which they have done. They are now using the tactic of telephoning my partner's mobile (which diverts from the the old house phone). I therefore telephoned from my mobile to give them a forwarding address (the firm of solicitors who I work for!!) for any court papers they would wish to forward. They asked me for my previous address which I refused to confirm and said they couldn't take any details from me without that as they didn't know who I was, to which I replied 'well I don't know who you are either'. He said he would mark my file as uncooperative which I said was fine as I wasn't prepared to cooperate any further with cowboys. I am now receiving calls on a daily basis which I totally ignore, including the mobile numbers they also use (I know the numbers of most people I wish to speak to and if anyone else urgently needs to speak then they will leave a message!). They will get fed up before I do! However, I am making a note of all their calls and they may find themselves in Court before I do for harassment, given that I stated from the outset not to send any threatening letters but just to get on with Court action as I would not respond to any docuents other than those. If they do go to Court action then I'm sure my firm will be happy to represent me, and more than happy to recoup their legal costs when Graham White 'Solicitors' lose, which I am confident they will (when and if they find me being as they were stupid enough not to take a forwarding address!). Unfortunately for them I am not vulnerable, I am in and out of Court every day in my work so if it came to that, then I'll have my day! So, if Graham White 'Solicitors' are reading this, GO FOR IT - unfortunately you will have to spend some more time and effort tracing me now as you had your chance and your team of bandits blew it by not taking those details! PS: I use the word 'solicitors' loosely as no legitimate or respectable solicitor would act in this manner, and should be struck off - most probably will, eventually.

Are you the same? It would seem odd if there are two of you in this whole circumstance but I can't help thinking one of the passwords has been forgotten!

Either way, this remark is mainly to Sallyshef as posted above here:

I appreciate your positive energy and your desire to fight those semi-evolved cretens. That's why it's not going to happen - you're too strong for them and they don't have a hope in a million of taking the matter to court. Your confidence is overt! They like simple targets as in people who are easily misguided, vulnerable and frightened of pieces of paper containing chequered borders. On here you are preaching to the converted though. The message is excellent and should no doubt induce courage to the unsuspecting but this is what you really need to do (for all our sakes) in your day to day life - spread the information to everybody. Even offer to take the wrap for those who receive such letters by telling them to name you. Once you get the first threatogram, your antagonist will crumble.

I'm on the band waggon of the APCOA-led nexus (you know who they are) and it has come to the stage that I now return their letters unopened - "Refused - return to sender" marked on the envelope. I sent them two communications telling them to commence litigation if they believed me to have a debt and to chase the driver whom I would not name, it seems they continue to write.

In your case, you can reverse the situation. Daily phonecalls? Are these logged? Never mind private numbers, if you keep the times on your mobile then authorities can have the number traced. I'm thinking along the lines of harassment. If you were to tackle it from that angle, they would be in the dock; and would owe you big money too. If I'm not mistaken, compensation for harassment is beyond a CCJ (I think magistrates do this as harassment is criminal) which means that if they don't pay and bailiffs cannot seize assets, they may have to earn the money from their rightful place - behind bars.

Just think of it this way, if a PPC believes they have a winnable case they would have taken you to court by now.

LOL, no, sallysheff is my only name! Different circumstances - they try to call a road a 'car park'. Complete with all the 'council' double yellow lines, single yellow lines, but MINUS a sign stating that it was a 'private access road'! Looks just like any other road and in fact no one who I have spoken to is aware that it is a privately owned road! What jokers - do they really think they'll win in Court? I don't think so! I immediately took photographs of the whole of the road from entering to where my vehicle was parked and to the exit of the road, should they sneak a few signs in meanwhile. And YES, I really do wish they would take it to court! However having given them ample opportunity of providing them with a forwarding address which they blew they can waste their time finding me first!! Their outfit is nothing more than a cowboy call centre - just imagine it, their minions sat at the desks just constantly going through piles of paperwork, calling, like those annoying idiots that call you at teatimes to sell you something, HOPING that they get a response! In fact I might just buy myself a very highpitched whistle!! They don't frighten me, just anger me, praying on the vulnerable. And yes harassment is a criminal offence. Give them enough rope and they'll hang themselves!

The problem is they just won't touch the court.

You've got more hope of luring them that way by prolonging their hopes and giving them rise to harass you. A piece of advice: should you report them to the police, don't lose your mind and tell the fuzz that you're not really worried by these communications. Have it known that the experience is tormenting you and that you have explained your legal grounds on which you believe the demand to be invalid and that the nexus have had ample opportunity to resolve the matter in court. That will be your first move.

I know! From the outset I told the company just to get on with it , not to send any letters, and that I would not respond to anything other than court documents, and still they persist! They just try and play mind games! It will be a costly exercise for them if they do because they will find themselves with a counterclaim for my solicitors court costs! In fact if they did start taking people to court, I'm sure some firm of solicitors would earn a mint acting against these cowboys.

"No win no fee" is a bit wishful here! Remember, you'd be the respondent with them chasing you for money and not the other way round. If they chased and ended up having to pay you - an amount enough to give 25% to your solicitor then that would be a miracle! ;)

:rotfl:LOL Yes, I realised what I put and edited it just before your reply.
  • Hi MSE
Great thread. Hope you can help!
I have recently received a letter from Roxburghe Debt Collectors demanding £122 as I have apparently not paid a parking charge notce that was allegedly sent to me back in May 2011 by APCOA Parking UK (Luton Airport) that I HAVE NEVER RECEIVED. I was there at the time and paid to park in the drop off/collection car park. It is possible that I did get court on camera stopping outside the car park momentarilly (30 seconds) and would normally put my 'hands up' and pay. However, this time, I have never received any such notice, only a letter from their debt collectors Roxburghe and was therefor never given the opportunity to pay the original fine. I did try to speak to someone at Roxburghe who told me that the original fine was £80 but when asked, could not give any details of what the fine was for!! and that Apcoa have now passed the debt onto them and the debt is now £122 and if I don't pay within 10 days, they will pass the matter on to their solicitors..... you guessed, Graham White. I soon realized that they are totally uninterested in anything you have to say and gave up. I am about to send a letter to them and copying Apcoa to demand proof of the alleged 'offence' together with proof of delivery of the original PCN, as without being able to provide this evidence, I am advised that no such debt exists. Is this true?
I hope to hear from you soon. Do I need to look here for your reply or will it be sent to my registered email address?
    Many thanks and regards,
    jenresman
