I should complain to the SRA about them. I know that this company are already being investigated, but another complaint wouldn't go amiss.
As an example of how this company operates their latest letter is quoting something called "Civil Procedure Rules : 31.16. Disclosure before proceedings start". I one slight problem with that ploy - that rule does not apply to the Small-Claims Court!What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

following my last entry - I have just recd this reply from FGW:
Thank you for your email of 18 October 2010. I was sorry to hear that you incurred a parking fine recently, which I note you have refused to pay.
If a customer does not park according to the rules clearly displayed in the car park then APCOA will issue a Parking Enforcement Notice. There are warnings related to this in the car park, which are also clearly displayed. I know you are disappointed but I would strongly advise that this fine is paid to avoid further legal proceedings.
It would not be feasible for us to simply charge the cost of an extra space, as this would not provide any incentive to customers to park in an appropriate manner. APCOA are within their rights to make a charge for parking over 2 spaces and this is primarily to reduce parking congestion and ensure that all vehicles are parked safely.
Until the fine is paid, it is likely that you will receive further contact from the debt collectors and I am sorry that this matter has escalated this far.
Thank you again for writing and for the opportunity to explain. I am sorry there is nothing further we can do to help.

You are falling into their trap , do not pay. Just hold firm. You can see how uninformed they are over this by repeatedly calling it a "fine".What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Get a grip. You are the reason these companies exist. if i sent you an invoice by e mail for reading this, would you pay it? No. No one can 'fine' you except the police, courts and unfortunately councils NOT a private company. Spend hours on here reading the threads, also on pepipoo and CAG. DO NOT pay them but get your own back on them like i do and get the word out there that they are nothing but thieves. If you cave in you legitimise their total scam. Totally ignore them NOTHING is going to happen to you whatsoever. It is as simple as that, ignore them and let them spend money sending begging letters.0 -
Hettie you have thousands of posts and threads here regarding ppc's, you have been offered advice directly by numorous posters, and you are ignoring it all and paying these people your hard earned money, you have fallen into their trap !
Can I ask have you ever heard of Martin Lewis ? Do you know what his advice is regarding this ? Basically what you are saying that Martin Lewis who owns this site and who is on tv it seems every morning is endorsing a lie, because he calls these tickets an invoice which is virtually unenforceable, now as you don't beleive him , what are you doing on his site ?
Can I askdo you know Ann Robinson ? You know the lady on watchdog, she last thursday called these tickets an invoice which has no basis in law, don't you think the bbc would have a whole legion of people advising on this matter !
If you still feel you owe them this money you go ahead and pay them, we can't help you further!Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Guess what they will do if you pay that £50? They will continue to hound you for the trumped up amount they now think you owe!
This is ONLY Roxburghe and their alter ego Graham White. They are VERY tame and well known and they never take anyone to Court. They are also already being investigated by the SRA I understand as tons of people have complained about them.
If you want to harassment to stop then the only way (without paying the scammers and you MUST NOT fall for that!) would be to report them as appropriate, see here:

There are loads of things that Roxburghe do wrong (pretending to be a Solicitor called Graham White is just one of them). Please report them as per that fact sheet.
And if they phone you again then read this out:
'Any alleged debt to that parking company is denied. Any further contact from you in the guise of Roxburghe or Graham White or any other names you use will be reported for harassment which is a criminal offence. So cease and desist with contacting me about this denied debt immediately. Good day.'
Then put the phone down.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I know these things can dominate your mind and become an undue worry.Look back at your original post where you were furious at how unfair all this is.At that stage you weren't frightened and were rightly prepared to fight on principle.
Fellow victims, diligent MSE's have supported and advised you of the positive outcome. What a pleasure it will be to win and how good you will feel at the end. In the meantime think of it like a begging letter from Nigeria. Nothing ever comes of it, if you don't fall for the scam.Instead of worrying about it,take pleasure in fighting for your principles.
Your own view of unfairness was that the invoice was disproportionate,which it clearly is and that is why you will win amongst other things.You don't actually say whether your parking actually caused a neighbouring bay to be unusable or just slightly awkward.If the latter, the Car Park's claim is absolutely NIL as their loss is exactly that ....NIL. You made a minor infraction that's all.
C'mon Hettie don't let these scammers win.:D0 -

It was listening to Martin Lewis on the Jeremy Vine show last year that made me challenge this Enforcement! :money:
Its this website's advice I used when I constructed my letters in response to APCOA's demands!
I've seen the Watchdog clip of the solicitor making a paper plane out of an enforcement letter! :mad:
I have a clear understanding of the legal aspects (I am a chartered professional of 19yrs) :A
BUT.....this is really worrying me and I want it to stop!
I have taken a stand because I believe in doing the right thing but this is making me ill......I cant ignore how I feel.
I have many other important battles to fight...I have a disabled son and getting support for my family over the last 4yrs has been all encompassing and I have no energy left to fight this 'battle' !
Having said that I spent 2 hrs constructing a detailed response to FGW so await their reply......:o0
