Write back to the solicitor thanking him for his views, stating that you disagree with his opinion and that you're looking forward to him presenting his client's argument, no, DEFENSE, in front of the judge, and that, as far as you're aware, the judge was the one who would decide if the banks are within their rights or not.
State that it is highly inappropriate, in your opinion, for the defendant to try and arrange an account review after you have initiated court proceedings, and that any communication betwen you should be made in writing until the claim has been resolved, and that THEN and only then will you be pleased to arrange an account review.
Should just about cover it all, methinks.
Good answer Bookworm. I'll have to make a note of that one. Interesting that they have done this though, without getting too into a deep discussion perhaps this is a new delaying/scare tactic?0 -

What I would like to know is how the hell do they think an account review will help this situation as I had one about 6 months ago! I have asked on several occasions to have my overdraft limit extended to no avail......
Oh well, getting on the case straight away, lets see what they come up with next.....................0 -
Babe28 wrote:Just a quick question, can you only claim for charges for late payment etc? As most of my charges are for being over my overdraft limit can I still claim? But its the banks charges that have put me over the limit, I've asked for an increase in my overdraft but got a no (cause they wont beable to get money out of me I expect). So I get charged by bank then they charge me again for putting me over my overdraft limit.
You can claim for all penalty charges - Returned DD, late payment, unauthorised OD etc.
You can't claim a definite service charge, i.e. a small monthly charge for free travel insurance that you never uselike the £10/month Natwest Advantage Gold account charge.

Unauthorised monthly overdraft charges, daily unauthorised charges, referral charges, paid/unpaid d/d, s/o fees, overlimit charges, late payments... *breathe*...
It might be quicker to say what you can't reclaim (and that in itself says a lot):
ATM charges, interest on your authorised o/d, monthly AUTHORISED o/d fees (some banks do have them, usually much smaller amount), charges for "special" accounts (gives you hol insurance or free breakdown kind of thing).0 -

I don't know about "new" per se, Gawd help them, they do try any which way to scare people off...
Weeeell, it can't be easy to see all those worms turn, now, can it?... They have to think fast to head us off, see if anything, ANYTHING at all can work!!!0 -

However, I have had a letter from a solicitor representing my bank who claim that the bank is well within their rights and that I should now contact my back within the next 7 days to arrange an account review!!??
Has anyone else experienced this?
Not sure what to do now!!!
Wot a cheek!!! Have now received a further letter from the solicitor representing my bank stating that they are willing to reimburse me for the charges which i am claiming. GREAT!!!!! I Thought! However this is on the condition that I agree to having an acount review and that I must then keep my account within the new limit agreed.
I am worried that this will result in further charges from my bank and concerned that I will be back to square 1 again...........0 -

That's nowt. I called this morning to find out an address to send my first letter to and the happy chappie on the other end of the phone told me that if I instigated a complaint they'd "blacklist" me "with all the other banks making it virtually impossible to get bank accounts/credit in the future".
Needless to say I'm even more determined now!0 -

Let them reimburse your account, go for the review then switch your account to another bank!0 -
Hmm i got a reply just before I posted my 2nd letter this morning (better two days late than never!)
It basically says that fees are clearly stated and i should read the terms and conditions, and my claim is unenforceable.
Then tells me to basically go away, see the Financial Ombudsman as this is hsbc's final response in the matter.
There's a PDF of the reply here:

Is this one of them standard replies?0
