Ultimately if he didn't like the terms and conditions then why did he rescue from them? He signed the contract...

He didn't have a problem with the terms and conditions - i did and use the food one to illustrate a point of my own.

The problem he has is being told while loading the dog into the car if it's ever returned by the Police or RSPCA it would be rehomed and not returned to him. That bit WASN'T on the terms and conditions. Neither was the stern finger pointing that went with it.

I'd like to think the rescue centre was able to exercise sensible judgement if the dog ever escaped in its lifetime and was picked up by the RSPCA and Police.

Imagine if someone has classed you as a bad owner and taken Kira off you because she accidently got out that one time. Doesn't bear thinking about....

It depends on how the dog got lost in the first place.

I'm assuming genuine accidental loss (the kind that turns you stomach over in fear when you realise what's happened) not being thrown out or ditched somewhere.

Then that would be unfair but as someone else said on here if the dog has a bad recall then he needs training.

I'd be thinking along the same lines as MrsTine, maybe he got confused & it wasn't what they meant, i'm not saying he's stupid, I don't know him, but if he mixed a Breeder & a Rescue up who knows?

My contract is quite long, I have a Rescue Dog & mine says if I can't keep her she must always go back to them for rehoming & I can't sell or part with her, only return her to them. It also keeps her Microchip registered to them which, IMO, is a *very* good idea. While I know i'd always update it, they don't & so many people don't bother or forget to. Also, they can keep track if a certain Dog keeps repeatedly going awol & take any necessary action.

The part about the food is unusual, but most Rescue contracts are based around ensuring a good life for the Dog & while you could say it's really not good to give Bakers, the Owner may give it Bakers. I know we all want choice about what to feed but it's not like they have a huge list of foods, just the one? And that IS a terrible food & they probably know what BC's are like on it.

My contract also says i'm the 'keeper' NOT the Owner, which is fine by me, to all intents & purposes she is my Dog, but if I don't look after her they can reclaim her. It says about regular worming & vaccinating, which is fine too as i'd do that anyway. I think as MrsTine said, he should take the Pup to training classes & *only* let it off if & when it has 100% recall which anyone responsible would do anyway.

I'm sure if he had a genuine accident & called them right off, they wouldn't reclaim the Dog. Also it's ID Tag (Which as i'm sure you know, is law to have) will mean the Dog Warden or Police will take it back to it's Owner the first time it goes awol & only to Rescue if he isn't home. I'd make sure the garden is secure with high enough fencing, probably 6ft i'd think? maybe more idk & only let if off lead in secure places once it has recall, then he's done all he can.

If the Pup went awol & they tried to rehome it, they probably couldn't as there's nothing in the contract or signed to say they told your BIL they would & any court would understand mistakes happen one/two times, anymore than that i'd question how he keeps it. So I really don't think he needs to worry tho I understand why he would x

Thanks for all of your replies everyone.

I'm going to feed all of your comments back to BIL. I think he's very nervous and concerned about doing the right thing and all of these posts will help him make the right choices.

To be honest, they sound a wonderful rescue :) Far better than some who will part with a dog to any old Joe who comes in with the money - and not even home check. I assume they have home checked him and the garden was passed as safe?

If bro in law is going to fret too much may be he should speak to the rescue about all this? Im not sure why he is worrying about the instructions or "finger pointing?" May be it was just the way of the rescue person, sometimes you find people involved with rescues have seen such awful things they find it difficult not to be a bit stern. The fact is this stern person passed him as a responsible adopter.:)

Bakers is rubbish food and the rescue may well have seen the results of using such food on pups?

Tell bro to get training sorted and a BC will need an awful lot of activity to keep him happy , they are just about one of the most intelligent dog breeds but they can develop real probs if they arent kept active.

NB, which rescue is it - pm if necessary - Id be quite interested about contacting them for potential places for the poundies.

It is not only rescue dogs that have contracts. Cat breeders sell cats with kitten agreements and they will frequently say that the breeder is to be contacted before any rehoming and of the contract is not adhered to the breeder retains the right to take the cat back.

That doesn't always work though. Some of my Bengal breeder friends have lost contact with some of the cats/kittens they have sold. Some who had sold their kittens as pets because they were only pet quality have found out that the owners have bred from them and sold them on after.

    Very intelligent animal!

Yep BC's generally are :) Kira is half BC half GSD so I know only too well what it's like having a highly intelligent dog ;) Problem is she sometimes plays stupid - now I KNOW she's not but she certainly likes to pretend to be... especially if the command she's been given isn't what she wanted to hear... Like "COME!" out in the field when she's spotted another dog...
