Hi all
I rent a 2 bed semi house out that i use to live in. This morning i had a phonecall from the neighbour joint to the property (heres me thinking god whats my tenant being doing.. visions of him complaining about noise or something lol). My tenant had given my mobile number to him as i live in another area. The neighbour told me he had had some new concrete posted fencing put up on my side of the front and back garden totalling £800. He then proceeds to ask would i contribute half towards it :eek:. I got in touch with my solicitor to check that was in fact my side (as i couldnt remember off the top of my head) to be told yes it was but even though i own it there is "no covenants to maintain it" So my old neighbour took it upon himself to rip MY fences down (ok they wernt that great) and replace them cause he had done the other side of his garden aswell.
He stated that he had tried to get my number off my tenant but hadnt seen my tenant for a few weeks. Just cant believe he went ahead without checking with me. I said to him if i was going to spend any money on new fencing it wouldnt have been that much and he should of asked me first. As a token i offered him £100 towards it. Baring in mind ive got enough on with my current mortage etc. Then he started shouting down the phone at me saying "cant believe thats all you are offering!" Baring in mind it was HIS decision to do this and by law he had no right to take my fence down and replace. Also i dont live there anymore so why would i be bothered with wanting swanky fencing!! Just cant believe it. Why would you do this? Everyone ive spoke to said they wouldnt offer him a penny even my solicitor said the same. Even if i had wanted to replace the fencing i wouldnt of spent that kinda money. Just thought i would share this madness with you all!! Rant over :mad:

Obviously now i have a nice looking fence which will help to show the garden off when i do decided to sell up. But that is not the point though it was his choice to shell out all the money. Just hope he doesnt give my tenant any !!!!!! over it. He's the gobby type that would!! He keeps trying to call my mobile now. Which is why you need to make sure he understands the legal situation.
And while you are about it, make sure you expalia to teh tenant, so they warn you if ever he starts something like this again.If you've have not made a mistake, you've made nothing0 -
By all means answer his call. Tell him quite simply that he had no right to take down and replace your fence. And if he's foolish enough to do so and then presume to ask you for a contribution towards the £800 bill he chose to run up without your agreement he should think himself extremely lucky to have such a mild mannered and good natured neigbour to actually be offered £100.0

If you have checked where the boundary is and the fence is on your land then it is your fence, if it is on his land its his fence.
In either case I would refuse a contribution.
What I would say is that you need to check how far it is on your land as the neighbour will be thinking that he owns everything within the fence, this may not be the case. Boundary disputes can be a legal nightmare.
There have been cases of fences being two, or three feet over the boundary, get it clarified and notify your neighbour ASAP.0
