the car doesnt look too bad in the ad, lol.

i think where it says stone and chips on the front end, it should say there on the windscreen.

to me it seems the car has had a dodgy MOT done and now its been a while he has decided to tell the car. thats how it works. if he had tried selling it right after the MOT it wouldnt have look right.

it doesnt make sense as how all that stuff can go wrong with the car within three months from DEC '09.

id be surprised if the car passes its next MOT without major repairs.

hope this helps.

Hi, thanks for the nice post, the car will not pass its next MOT, this has allready been stated by the paint shop that is next door to the MOT test station, but they commented purely on the lights and windscreen, not the mechanics.

I really dont suspect a dodgy MOT, as my faith in human nature is still quite good, the car has too much wrong with it for any MOT tester to put their stamp or job on the line for it, I fully believe all the damage has been done in the 4000 miles since the MOT.

Which to me means the car was ok when purchased, then abused until it was on the point of collasping, then sold quickly in order to get another one. Just my opinion, but hopefully the MOT that is booked in for Monday will clarify many points.

The arguments have gone on long enough on whether the car is sound or not and no one is going to agree on that.

So what are you going to do about it? Talk is cheap!

Can I suggest we call a truce until the MOT results are known on Monday?
Otherwise we're going to need the UN's forum peace-keeping force to get involved...

I have spoken to trading standards, and on their advice booked the car in for MOT on Monday.

Have spoken to Consumer Direct, and on their advice sent a recorded delivery letter to the seller.

Have sent another 2 mails to the seller, and despite the assurance on this very board yesterday that they would respond to my emails sent yesterday, no response to the 2 yesterday or the 2 today, despite read receipts to them all, all in an effort to resolve the issue.

Not convinced the MOT is relevant. The OP needed to check vehicle to their satisfaction (but is the me fanning the flames again  )

Stop fanning! it's far to hot in here! lol

The MOT is just to establish the CURRENT roadworthiness of the car

I fail to see what regulatory power Trading Standards have over a private motor sale? And how can it be illegal to sell an 'unroadworthy' car? MOT failures or collision damaged vehicles are bought and sold every day.
The issue here is if the seller wilfully misrepresented the car's condition, which I'm not convinced has been established.

The idea here may be to scare the seller (knowing that she/he is aware of this thread) into taking the Mondeo back.

Note the earlier mention of a criminal case?

See hollow threats.

Email from Consumer Direct

Dear Ms *****

Thank you for your enquiry to Consumer Direct dated 12/3/09. Your reference number for this case is NE****** and should be quoted in all further correspondence regarding this case.

Based on the information supplied within your email the key facts of the case appear to be as follows: You purchased a used car from a private seller via Ebay. The car was described as been mechanically sound, with no knocks or rattles and has been well maintained. You have developed faults with the steering rack, drive shafts, CV joints, there is damage to the windscreen and front lights. You have spoken to the seller who has offered to refund £80.

You have a contract with the seller which is covered by the Sale of Goods Act 1979. When you purchase goods from a private seller you get rights that the goods are as described. If these goods are not as described then you would be entitled to one of the three things:

The goods as described,
The difference in cost between what was described and what you were supplied with, or
A refund

The next step would be to send the seller a letter by recorded delivery of which you keep a copy stating this and see how they respond. I have attached a template letter which may be of use to you.

If you require any further advice or information about this case, please do not hesitate to contact Consumer Direct on 08454 04 05 06 quoting the case reference number.

Thank you for your enquiry.
