I'll keep you all updated I will be phoning trading standards tomorrow to see what they say. I am a long time reader first time poster, and I must say I'm overwhelmed with the comments I have received its really good. When do I get to be on the TV haha
I am now come to the conclusion I will not be returning this item the Curry's they asked me yesterday to return it today, but I'm not going out of my way to return it, I have not received another phone call yet, so maybe they were trying to call me bluff in the hope that I would take it back.0 -

As already pointed out, they wouldn't be chasing you if the opposite had happened and you had been given a lesser spec camera, would they? :rolleyes:
How is that any kind of defence?
Let's say someone notices they've been sent a lower spec camera in error. They attempt to return it for the correct one, but the salesman said "why should I bother, you wouldn't have tried to return it if it was a higher spec one :rolleyes:"

Of course you have every right to keep the camera, it is their mistake. If I was to give it back I would want them to collect it at my convenience.
However that said they are well within their rights to refuse service if anything goes wrong with the camera.
I work for a servicing company and I see time and time again people with higher spec products than they have paid for, they never take the stuff back and cry like babies when repairs are refused. Its a gamble you take my friend plus there is a lot to be said for honesty.0 -
Those that are suggesting the OP returns the camera, not an idea that i will argue, would the OP be entitled to invoice Curry.s for his time/travel expenses etc???
I purchased a product (can't remember what) from either Currys or Comet a number of years ago through the 10 month interest free option. Some days later I received a call from the shop, asking me to return to the store as the paperwork hadn't been filled in correctly. I lived around 35 miles from the store and told them I would only go back if they paid my petrol money. The lady I spoke to seemed dismayed at my request but went to speak to her manager, when she came back to the phone she offered me £10. I refused to travel to the store for £10 and was offered £20 which I gladly took.
Not sure how far the OP lives from the store, maybe he should charge them £200 in petrol costs and time and then see if they want him to take it back
Please bear in mind that the £200 difference between the camera you thought you were getting and the camera you got includes their profit and, as the camera is now used, it probably isn't worth their while getting it back.Thrifty Till 50 Then Spend Till the End

In most cases I'll have a strong "moral" feeling about what to do.
However, I'm really struggling to agree that you should take it back.
You paid for an item and walked out of the shop with it. At that point the shop were happy that you had paid for it. I believe it became your possession at that moment.
TBH, my feeling is that it's too late for them to do anything and they are just hoping to appeal to your kind side in acknowledging that they made a mistake. What you do depends on how high an opinion you have of the store and their staff.Happy chappy0 -
The muppet staff member who sold the wrong camera should have to give Currys the difference out of his/her wages.OP keeps the camera.Muppet never makes the same mistake again. Store recompensed. Everyone is happy except the muppet. Simple0

I've worked in many shops over the years and have been told that as soon as an item is bought and paid for it is the property of the purchaser......if the item is the wrong item it's still the property of the purchaser, once the transaction has been completed the retailer has agreed to surrender those goods to the purchaser, it's too late for them "back out", mistakes MUST be spotted before money has exchanged hands.
I wouldn't return it tbh. The shop messed up, it's their problem not yours.0 -
I doubt they will chase you for it as they have no legs to stand on with regards to getting it back.
However it is disappointing to see that a board that is all about getting a fair deal for the consumer can't see that fairness is a two way thing.
Surely the decent thing to do is acknowledge the mistake and ask them to deliver the correct camera to you and collect the wrong one at a time and place which is convenient to you.
I'm sure if it had been a cheaper camera you would have been asking how to get what you paid for.0
