the other way to look at it is if the stores put up the disclaimers as they should and briefed all staff involved then there would be no R&R and no need for a reduction.

Incidentally, Trading Standards will tell you that if you purposely buy an item knowing that you are going to be overcharged, the Consumer Protection Act won't help you. Want to disagree with me on this? I suggest you check out the CPA a bit more thoroughly. You'll see it refers to ambiguous or misleading pricing. If you go into a store KNOWING that you are going to be charged more at the till than the stated POS or SEL, you have not been overcharged. You've been charged the price you expected to be charged. Get it? If Tesco can prove you've purposely bought an item in order to be charged more than the SEL (as you already knew the price you'd be charged at the till), they can refuse to r&r. Tesco can prove this by many means. If you are observed checking prices on an instore scanner, for example, or if you are carrying around a print out of the mispriced items, these can all be used to show that you are purposely trying to be overcharged.

When I got my r&r on the mobile today, I fully expected the CS rep to say no. She even called the store manager without me saying a word. He told her to r&r me. Had she said that the leaflet was a misprint, I would not have pushed for an r&r, as there was a sign up saying that the leaflet was a misprint. I also told her that I'd been undercharged on another item, to which she replied "Don't worry about it. It's our mistake."
I received an e mail from Tesco customer service today in reply to this:
"as i have been overcharged recently i now check prices carefully when instore and often spot misprices, if i see a misprice or i use the instore scanner and find a price incorrect, if i then go on to buy what i know is a misprice and am overcharged am i still entitled to r&r"
They replied to the effect of: (sorry don`t know how to put their bit from e mail onto here)
"If you go through the checkout with any item and you are overcharged you are entitled to a full refund and you keep the product" They then go on to EXPLAIN TO ME! what is a misprice and what is not! There were two examples of what is not and five of what is! This i will definately print out and take to Tesco`s with me. _party_0 -
My father went to the Leytonstone branch and bought the named phone and paid by credit card. The assistant behind the desk swiped his card and went off to fetch the phone. After 5 minutes the assistant had still not returned so my father looked through the door he had gone through and noticed that the assistant was now talking to another man and finally returned without the phone. He told my father that Tesco's were out of stock of that particular phone and gave my father back a refund. Two things have occured to me since my fatnher told me this which is 1. Wouldnt the assistant have known if this item was out of stock BEFORE my father paid for it and 2. Are they legally obliged to provide the item once its paid for and not prtend it is out of stock.0

You'll get different answers from different members of staff at HO. Everything I stated in the post you've quoted is true. If you buy an item knowing that you will be charged a higher price at the till than is shown on the SEL, you're not being overcharged. You already know the price you're going to be charged (having seen it on here, or seen it when using an instore scanner), therefore you accept that price when taking it through the till. The SEL is an invitation to treat. You make an offer to buy the item when you take it through the till. If you know the item is going to scan at £9.99 (even though the SEL says £8.99), your offer is to pay £9.99 for that item. As you already know the item will scan at the higher price, you're accepting that price if you then decide to buy it. That's how TS sees it. As said before, contact TS if you don't believe me. Proving that you knew you were going to be charged more than the SEL is another thing, though. That's why some people on this thread are now being refused r&r on the basis that they do it far too often and have drawn attention to themselves.In a rut? Can't get out? Don't know why?

I think its this Obsession with RRing. Shame our life here has started to revolve around it. First thing Hubby does now when I meet him off the train is ask what I managed to get today. There must be other RRers who have become exhausted with it. Even this board exhausts one. But there will I be doing it next week....I dont know. Those looks from CS, the blushing. Is it good for the heallth??0

Had the same experience re v171 phones myself - lied thru their teeth & couldn't even get their stories right one minute out of stock the next minute they have been removed from sale after being sold. Even led me to believe they'd refund and provide phones of equivalent value but alas it was merely a swindle attempt as by then they'd refunded me.
Also, regarding claiming R&R too often - well I have a big family and Tesco has an even bigger number of stores so what's the score there then? All it achieves is one mega peeved off customer who is nx more determined to visit every Tesco store in one week for maximum goods then come here post the misprices so everyone else can do the same. - Okay well that's what I do anyway! There's no way anyone gets out from a R&R with me - even if they think they do!0 -
