Incidentally, Trading Standards will tell you that if you purposely buy an item knowing that you are going to be overcharged, the Consumer Protection Act won't help you. Want to disagree with me on this? I suggest you check out the CPA a bit more thoroughly. You'll see it refers to ambiguous or misleading pricing. If you go into a store KNOWING that you are going to be charged more at the till than the stated POS or SEL, you have not been overcharged. You've been charged the price you expected to be charged. Get it? If Tesco can prove you've purposely bought an item in order to be charged more than the SEL (as you already knew the price you'd be charged at the till), they can refuse to r&r. Tesco can prove this by many means. If you are observed checking prices on an instore scanner, for example, or if you are carrying around a print out of the mispriced items, these can all be used to show that you are purposely trying to be overcharged.
Ring TS, if you don't believe me.
When I got my r&r on the mobile today, I fully expected the CS rep to say no. She even called the store manager without me saying a word. He told her to r&r me. Had she said that the leaflet was a misprint, I would not have pushed for an r&r, as there was a sign up saying that the leaflet was a misprint. I also told her that I'd been undercharged on another item, to which she replied "Don't worry about it. It's our mistake."In a rut? Can't get out? Don't know why?

That's all well and good but Tesco can refuse an R+R anyway. It's only a policy whose benefit passed on to the customer in excess of rights under the CPA.Can I help?0

It's not that easy for Tesco to refuse to honour r&r, as it's a nationally advertised policy. It could be argued that people partly base their purchasing decisions on Tesco's policy. If Tesco then choose to only honour it when and if they feel like it, they could find themselves on very thin ice as far as TS is concerned. Being as it's a nationally advertised policy, it could be seen by a court as a condition of the contract of sale (it's an offer), and not just part of the invitation to treat.
Carlill v Carbolic Smoke Ball Company (1893) set a precedent for this sort of thing.In a rut? Can't get out? Don't know why?
