Just stick to your guns
1. You were sent email confirmation of the price
2. On the web the price in your basket and in the Top Offers is £5.01 per bottle. Make sure they can see this and not viewing a different page. Its a pricing error so there fault. Not allowed to sell at one price and charge another
3. The T&C's state if large price difference will refund.
4. This worked for me!!
Could remind them of previous Gamecube bundle offers. . . . .Cheers
Jon

Order arrived, but with the some blue alcopop thing substituted for the vodka. As all I had ordered was the vodka, I refused the whole order. Now I have to see whether they will refund my delivery charge. The driver was doubtful, as I had not indicated 'no substitutions'. I had actually tried to do that, but unfortunately, the system would not let me back in to change my order, even straight after I had placed it. It kept saying, 'you have not changed any quantities, you do not need to check out again.'
I shall phone them and see what happens.A penny saved is a penny gained0 -

er....they have offered a refund as their t&c's state and they haven't done anything wrong - admittedly they made a mistake on their website....arguing with them won't make their t&c's magicly change!

i don't think they can charge you the delivery charge if you've point blank refused to take the order as this is the first point at which they tell you they've substituted/charged a different price
although i couldn't find anything in the t&c's about this....anyone?
EDIT: see next post0 -
I phoned just now to tell them what had happened and said I had tried to put a 'no substitutions' note on the order, but the sytem wouldn't let me back in.
They apologised and refunded my service charge without a whimper!
As they say, nothing ventured, nothing gained.A penny saved is a penny gained0 -
Yep but I think if there are two prices on an item they have to charge the lower one. If they emailed you before delivery saying the price was different then you agreed thats fair enough.
T&C's dont negate Trade Discriptions act etc .Cheers

WOOOOOOHOOOOOOOOO
A nice result in my favour the C.S. operator just rang me back having spoken with the top dog..
He has said that a refund has been authorised by the manager and should be back on my card within 48hr ;D
so instead of paying £35.95 for 2 bottles I have the pleasure of paying £16.01 the orig price ;D
sock it to em gang ;D
and heres a toast to Jon E Boy0 -

the contract is not formed at that point though....it's when the items are charged at the till
if the difference between the items is more than you are willing to pay then they have to offer you a refund - which they are doing0 -
As someone else said; nothing ventured nothing gained. ;D0
