Last year i purchased a phone from Talkworldonline, with the 12 months line rental cashback offer.
I received 1 cheque on month 4, but now i am having problems receiving cheque number 2 and 3.
There is not answer on any their phone/fax numbers and it looks like maybe they have gone out of business?
Can anyone help or know anything different? WHat rights do we have? I am guessing that i have lost out?0 -
Their website seems to be up and running. If there was a problem you might expect there to be a note on there, ie from an administrator.
If they were insolvent then I guess your rights to be those of a normal creditor. That means that you will come more or less last in the queue after the inland revenue and the banks etc.
However, assuming that they are still solvent then you will need to write them a letter telling them that you expect to be paid out as per the contract detail, otherwise you will be starting a claim in the County Court in order to recover from them any monies owed, and in addition, any costs incurred by yourself in pursuit of your claim. I would advise Trading Standards of the situation too. They may well be accumulating a sizeable dossier relating to this trader.0 -
Hi, I am in the same boat. I sent in my claim form to talkworld on the 1st November 2005. No answer. One phone call early in January, which said the claim was approved. They dont answer phones or e-mails any more.
Suggested way forward.
1. seek the network operation "three" to honour the deal. I spoke to them 1 day ago and they confirmed that talkworldonline was still an active agent of theirs". This is a scam which the operators are involved in. They get their phones sold and lkine rental paid. We are out of pocket. Any thoughts whether this would work?
2. claim teh money of VISA as paid for the initial phone with my VISA card.
Chasing talkworld through the small claims courts will not help me if they are insolvent or have disappeared.
I like the first option - as even if I am not successful, three cannot stop me having my day court to outline how they are equally to blame as talkworld to honour the contract.
any suggestions appreciate.

1. Network 3 will honour the deal, ie you pay the line rental and they will continue to provide you with service.
Your wording, if referring to 3, may be libellous.
2. The credit card option may help, but I doubt it. The service was bought and is being provided.
3. You cannot take 3 to court over this because your contract is with Talkworldonline. You have been told that Talkworldonline are still solvent and therefore your redress is to them.0 -
Steve_xx i am sure you are right that my contract is with talkworld and not three. However, this is not an isolated case. Mobile operators KNOW their phones are being sold on deals that are none sustainable! However, it sells phones - so they dont question them.
Secondly, we are all entitled to our day in court. Three cannot stop me :-
1. raising a small claim against them,
2. they will have 14 days to legally respond to it,
3. they will have to attend court (or send a representative to defend their position).
What will I get out of taking this action:-
- it will get bad publicity for three,
- hopefully encourages others to take similar courses action against their network operators,
- it will cost three greater than my cashback settle to defend the case.
The other beauty of it is, that three cannot pass any legal costs back to me - it is a condition of the small claims court procedure (or moneyclaim online).
Any thoughts.
Lastly, I am convinced that Talkworld have disappeared from this thread and not answering their telephone calls - even their sales line is not being answered.

In the first line of your response you have admitted that 3 are not responsible. So why do you think it a right thing to bring court action against them?
The fact that 3 sell phones to others who sell them on is not relevant in your case. Your case has to be primarily related to Talkworldonline, who are possibly still trading. You cannot leapfrog to 3 in the way you suggest. Your redress is to Talkworldonline.
You may well raise a claim against 3, and they may well respond with a counterclaim. It will not get any publicity for 3, nobody but yourself and 3 will know anything about it. The adjudicator may not be too happy that you have brought the case in the first place, given that the people you have the contract with may still be in business and the fact that 3 are continuing to provide you with what they contracted to.0 -
I think we have all been conned by Talkworld Online...
1. No answer to emails or calls
2. I sourced the number via royal mail and yellow pages of the detist who shares the same address - i asked if the shop was still open and she said she didn't know what has happened. Not sure if people are there or not?
Do you think that spending £30 with https://www.moneyclaim.gov.uk/ will actually get us the money we are owed if Talkworld have gone into liquidation?
I called Money Claim helpline and they suggested i find out if they have gone into liquidation before i make the claim - how do i do this??

Right then. well there's no point in your issuing proceedings if they are defunct. You could try and find out who the Administrators are and lodge a claim with them. But do bear in mind that you will be at the back of the queue, after the revenue and the banks, and I honestly don't think you will receive anything.0
