  • Ok its easy to miss emotion in words or misunderstand what someone is saying so I'm sorry for any of that. Its also easy to get wound up quick on here especially if the CSA are doing their thing to you. Lets not loose track of your thread Monicaj.

    We have an appointment with a Child/Family Law specialist on Monday morning and will keep this thread updated. In the meantime thanks to you all for your posts.
  • I think getting the money back from the CSA is very important. It will help to send the signal to the gestapo that they need to very careful about how they behave, so I am completely with pd001 on that.

    As far as I'm aware though, the gestapo have no legal power to recover the money from the PWC under these circumstances (although no doubt Kelloggs will correct me if I'm wrong!). I believe they can ask but not insist. Therefore demanding the money back (with interest, yes!) doesn't impact on the PWC (who, to be fair, has had to bring the child up over the years).

  • just a thought if you do get any money back from the (gestapo) sorry c.s.a what about putting some of the money in a trust fund for the child say when he turns 18 or 21 or even when he gets married.just an idea it might make you and your husband feel like you have done what you can in a very arwkard situation.(i thought i had a problem with the csa until i read your post best wishes and i hope it turns out for the best)

    The OP has said that they want to save for the child so I am sure they will do that.

    I regard to the PWC having to bring up the child over the years, by saying this chap was the father it has taken true finiancial responsibily from the real father - who should have been paying for all of these years.

    If this woman knew who the real father was but named this chap instead because she knew he was more likely to pay or could get more money from him then she has to answer to this. If she knew - which let's be honest, she must have known there might have been a chance if she was getting it elsewhere - then she has commited fraud. Moreso if she then goes on to blackmail this chap - who has spent 10 years forging a bond with this little boy - for money in exchange for contact then I think that yes, she should be made to pay it back and the real father chased for the money as she clearly knows who it is. By doing this she could ruin her childs life, how is he going to feel when he finds out - and let's be honest, one day he will.

    Unfortunately the only people who suffer at the hands of the CSA are the parents who want to pay, those who do not then usually don't and will avoid everything to do so, and the CSA don't care so much as it is harder to get the money. I wonder if they are so quick to refund and take action when it is found out that a man is not the real father after all and that the mother LIED.

    We have been told (verbally) that they will immediately refund what has been paid to the governement and will persue her for the remainder, if she cannot pay, he will be refunded but she will always owe the state.

    If we do decide to take the "refund" route, then that is absolutley what our views are it would be deposited for his future.

    We think this is exactly what she has done, taken advantage of his good, kind nature for financial gain without a second thought about the potential devastation for her son and my husband.
