  • I think you mean the Data Protection Act. Freedom of Information is to do with accessing information held by the government.

    The law says 40 days to deliver the information but the CSA is not registered under the Act thus doesn't charge the statutory £10 fee so the CSA might not have an obligation to deliver according to a time limit.

    We have had hundreds of people request their account information plus a breakdown of arrears in this way under the FOI and it has never failed, so whilst i am not saying you are incorrect, i am saying that this is a tried and tested method used by members we have and hundreds of fathers who have asked for help and the CSA have been compliant with each and every request, we are sure that if this wasn't the case the CSA would have put each father correct as to the Act under which to request information.

    Oh really?, again,not getting into the whys and where fors but,,,,,,,,,, how come then the CSA have had their hands slapped countless times for failing to supply inofrmation in the specified 40 CONSECUTIVE days under the said Act?!!!!! by the Information Commisioner, non the less. It is regularly bought up in Parliamnet and they are told numerous times to comply with DPA requests on time, but inevitably they don't!!!!!!! Not nit picking just saying it as it happens.
    They do not charge the statutory fee of £10, correct, but they do comply, eventually with each request, so if they aren't under any legal obligation to comply, why do they do it and why is the Information Commissioner slapping them left right and centre for failing?!! Just curious as we have copies of the complaints upheld by the Commissioner against the CSA from as early as 1998.

  • It would well be some other legislation obligating the CSA, a non data-protection registrant to comply with the Act.

    BTW are CSA employees allowed to give personal advice on public forums? Conflict of intrests maybe. How qualified are they considering i hear differing answers to the same questions all the times. And how well do they know legislation?
    Even arrears balance is different each time i call them and it is sometimes higher!!!!!

    Ive done an XLS sheet with all my payments since the middle of 2005 and I've paid a total of £25778.15. Mind boggling.

    Well I've written to my MP so should get an answer over the next few days.

    The MP's assistant is now your best friend. Get them on your side and things will start to turn round in your favour.

    can only agree with this, my MP has threatened to raise my issue of the CSA not complying with the ICE's recommendations by the date that they said they would (6th February) Since my MP got involved they have had 2 phonecall's stating they are working on a response! still waiting on this, but my MP's secretary basically said she doesnt feel that it will be in my favour.only time will tell

    Is the secretary just the secretary or the assistant? What do they know about the CSA anyway?

    You have made me very angry with your comment. Just because you work for the gestapo doesn't mean you should be sticking up for them when they get it wrong and in so many many cases they get it wrong on a massive scale. I think you will find that I don't stick up for them if they are wrong. I have helped many an NRP get what is right and fair. If you want help, I am willing to give it if I feel I can - if I can't then I can't! But if you don't want any help then that is also fine, it is no skin off my nose.

    I ask you now, when they realise they owe me £4000 ish and have to pay it back to me and possibly with compo, who will they chase for the money. My ex has been overpaid massively so will they take the cash back from her? If so my son will go without.
    They will ask her to repay the money but she doesn't actually have to repay it - but the CSA should be paying you back regardless.
