One day this will be all over for you both, and you can get on with your lives. Good news about the witness. Curious to know what the reasons were for asking for a postponment, were they valid reasons and why such a delay. Did you have any opportunity to make any form of response relating to their request? Not that you would have any say in the tribunals decision to agree to the request just curious I guess.
If you can get help for the tribunal appearance that would be great but from what I remember about the effort you put in over many months I think that you would be a fearsome representative for your OH:mad:

Hi - apparently they wanted it delayed because of employees being on holiday. No other reason really, we couldn't exactly argue against that.

Glad you are moving on & OH's job is going well.
I'm sure it won't happen, but don't let the time delays put you off at tribunal. Remember that the chairperson will make allowances for you representing yourself - they should guide you if necessary.0 -
Just thought I would update -
Got a letter copied to us from the tribunal. They have given the employers until 5th Aug to send us and the tribunal a copy of the customer comments book. I reckong they have chucked it though, so will be interesting to see what the next step is.
Also, got some crank calls tonight, we reckon the culprit is a relative of the person who fired hubby, as he worked there as well. Phone is on silent, we are keeping a record of the calls.Learn from yesterday, live for today, hope for tomorrow. :cheesy:0 -
We have heard that his tribunal will be heard over 3 days at the beginning of October.
Sadly, OH's friend/ex manager who was to be a witness for the tribunal died this afternoon. He was a great guy and will be sadly missed. RIPLearn from yesterday, live for today, hope for tomorrow. :cheesy:0 -

We have a new witness!!!
One of the guys who supplied a statement no longer works for the company, so OH phoned him up and asked what the heck had gone on. The guy admitted that they were all told to say they were being bullied!!
I am going to see him (he is okay with this) to take a new statement, ask questions and see if he would be prepared to speak at the tribunal and I have asked that he has a relative there when I speak with him, so no one can say I coerced or bullied him in any way. I might ask him if it's ok to record the conversation, just to be on the safe side.

That's great news Amber, good luck with it! OH is taking his ex employer to tribunal for unfair dismissal, just got the date through for the hearing so will have to start collating all the info, a bit daunting but I'm hoping it will be worth it in the end!0

Hello, back again for a new update (if anyone is still reading lol)
I went to see our new witness and, in a nutshell:
- They told him he was being bullied and asked the guys to write a statement to that fact. The employee handed his in and they wrote it up but when he got it back they had reworded it and added bits - he said those weren't all his words, and he went through his statement scoring out the parts that he didn't write (the worst parts as it happens)
- He said he did not feel bullied at any time, he enjoyed working there and he has never had a complaint about OH
- He hasn't been asked to be at the tribunal as a witness, in fact they told him when this kicked off that 'it will never get as far as a tribunal'!!
- The managing director was meant to re-investigate after the Appeal hearing - this employee said he has never spoken to him about any of this (so he couldn't have confirmed his statement to him as the MD said he did)
Also, when he got fired 4 weeks ago (for being late twice) the Ops director said to him 'we need to lose 6 bodies from the company - you're one of them.
Everything went quiet for a bit after that, but we have now had 2 letters from the ex employers:
The first asks for our legal representative's contact details/address for future correspondence.
The second is asking for full employment details since OH's dismissal, date employment commenced, details of renumeration resulting from employment, including bonuses, a copy of the contract of employment and details of any benefits received since dismissal.
^^Is it standard practice to ask for all of that detail? Fair enough the employment, but the benefits from when he was out of work??? We will have to send them though, they have stated they will apply for an order to be issued if he doesn't send them within 7 days :rolleyes:
