    Hi everyone - thanks for the further info. We have just been on holiday, was nice to get away from everything and put all this mess out of our minds for a bit.

    Anyway, had some paperwork waiting for us when we got back:

    - First was a reply to our ET1 form, his ex employers simply saying that they will resist his claim and that the procedure was followed at all times. (When I think how much details I squeezed into that info section...LOL):rotfl:

    - Next was a letter from the ET asking what dates OH would not be available during Aug and Sep, also asking for the number of witnesses, as well as their names, length of evidence, why the evidence is elevant and finally how many days does he think it will take to hear the case :confused:

    - Also, his ex employers have written asking for it to be postponed to Oct, and have been sent a letter (all this has been copied to us) asking why, and for all their exact details




    The part I have highlighted in bold is the part I am struggling with a bit. Everyone who could be a witness still works for the company and I very much doubt anyone is going to risk their jobs (espcially in this economic climate) in order to give evidence against their employer.

    Also - how are we supposed to know how long these things will take? I was going to perhaps put 2 days in the time box, because things do seem quite complicated.:confused:

    Incidentally...the job Hubby started in April - he came home the other night brandishing a set of keys...the boss has given him a set so he can open up, and he will even be running the place himself on certain days.

    He says it's nice to be trusted again, he is still happier in the new job, so much less stress and he is home at 5.30pm instead of 7pm every night. :D

    Well done Amber and OH. I am so glad that someone has stood up to a bully employer!

    As an ex HR Manager, its brilliant to hear!

    When you send your forms back regarding witnesses, I would make sure you ask for your OH's ex employers to disclose the Customer Comments Book. This could be very relevant.

    Also, the staff member who your OH gave a lift to and from work - give them his details. I realise he has given a statement to your OH's "Prosecution" but furnish the ET about the fact he accepted lifts for a period of time - its crucial information.

    Thanks for your points. OH did go in to try and find the comments book but it had disappeared, he thinks they have thrown it out.

    I would never have thought about asking the person he gave a lift to to provide a statement. We have put a note in the list of questions regarding this. Will make sure we give their details.




    We have 3 witnesses to put down - OH's previous area manager, who worked with him for 9 years before he moved jobs. A customer who is refusting one of the claims -OH done a free job for him (valued customer) and the company are accusing him of accepting cash in hand. The customer provided a statement to say nothing of the sort happened. Pity he emigrated in April, so his written statement will have to suffice.

    But - the best news is.......after work today, OH went to see the man who was his under manager at the time of all this so called gross misconduct. And he is going to be a witness!:j This is fantastic news, as he can totally back up OH's explanations.

    What annoys me most is that OH went to the appeal with a list of Q's, and the MD said he was going to conduct his own investigation. We never did get an answer to any of his questions, just a generic 'we are upholding the decision' letter.

    It's standard. In the eys of the Tribunal, you need to be seen to be going down every route to resolve the problems yourselves.

    Just a quick update:

    Had a letter from the tribunal asking us to clarify if we are seeking an order from them for the employers to disclose the customer comments book. I replied with 'respectfully, yes' and outlined the reason for it.

    On the downside, the company got their way and have managed to get the tribunal pushed right back and we are now looking at Oct/Nov:mad:

    We are going back to CAB to see if there is anyone who will be available to attend the tribunal with us when the time comes.
