    Go girl!

    Take a deep breath & submit the ET form.

    You have given them every opportunity to right their wrongs, now let the tribunal decide.
  • Hi Amber,
    Don't let that put you off, probably a ploy to make you back away. They have probably seen the error of there ways so have taken this avenue!
    Hit them by applying to the tribunal for failure to follow the minimum procedures as required by law at the time all this took place, let them know that you are not going to go away.
    Think hard before engaging any lawyers as their charges will be very high and you will be responsible for the costs as awards for costs at tribunal are very rare. Keep away from 'No Win No Fee' as their fees will be deducted out of any award your OH may receive. Check to see if you could still qualify for legal aid, may not now that OH has got a job.

    Do consider self representation, you have done a sterling job up to this point and maybe once they see you are not backing off and when they read the catalogue of errors they have made along the way they may just decide to settle before any tribunal.

    Well whatever you decide I think you know we all think you have a good case and of course we will be here if you need us.

    I agree with Burny, consider representing yourself.

    Tribunals are about considering the facts. The work you have put in & the advice you have been given have enabled you to identify the facts (and the errors made by the company).

    At a tribunal hearing, the chair person should guide you to enable you to represent yourself.

    In any case, it is worth considering now what you want out of it - so you are in a position to negotiate settlement pre-tribunal.

    Hi - thanks for all the replies.

    We have decided to hold off on the lawyer front until we see how things pan out. OH took some persuading but I convinced him that I/you lot know better, hehe ;)

    I noticed on here a thread about starting an ET, going to have a read through that to find out how to kick things off.

    The advisor we saw at CAB a few weeks back did offer to help us fill out the forms, unfortunately she has too many cases to be able to go to court. OH doesn't want to take any days off in his new job though, do you think that CAB will see me on his behalf? Or will he have to be there?

    Incidentally, OH enjoyed the first day in his new job. He is the youngest member of the team (at 34!) and he is amused by the rule that no work gets started until everyone has had their first coffee :rotfl:

    They seem quite laid back and easy going, one guy even told him to slow down because he was making the rest of them look bad :rotfl:And his employer is honouring OH's holiday - we have 2 weeks booked for end of May/beginning of June, which were all arranged and paid for in January before any of this kicked off - so it will be nice to get a break from it all.

    So....the challenge of learning about ET's starts tomorrow!! :eek:

    Oh...does anyone know how long it should take a company to send out a P45?

    OH phoned up his ex-employers today to be told that he wasn't registered as having left yet (or something to that effect, I will check) so it won't be done until the end of this month.

    No biggie really, just wondered if it usually takes a couple of months.

    If he's still owed money by the company (havent read all the way back) he wont get it until after he's been paid. He should have it up to two weeks after employment ended, and final payment paid. Im sure he can still fill in a P46 though and then add his P45 in once he gets it.

    Your OH can fill in a P46 (you should be able to down load this from the HMRC website) which will sufficient for his new employers to deduct tax at the right rate.

    He got a final wage at the end of February, ot expecting anything else from them lol

    Will download a P46 form, thanks mo-debt
